They’ve also worked into the calculus that they can afford the best/biggest law firms to defend them in the inevitable law suit, while the passenger is probably going to have to hire an under-resourced plaintiff’s firm working on contingency.

The law suit is the least of United’s problems, even though the passenger will probably end up being well-represeted.

The PR hit is going to be severe all by itself, and United’s competitors may even end up using this in their advertising.
