I’m not sure, but I think you misunderstand me. My point was that publicizing Churchill’s many outrageous remarks might have been a useful strategy pre-trial to prejudice the jury pool. During the trial, it would have merely reinforced the opinion that CU fired Churchill because of that speech.

I agree with your other conclusions, although I think even this MacJury would have found for CU had O’Rourke done his job.
