There is barely a chance HD will be criminalized in the USA, so yeah, we are not talking about the US system.

Also, we were not talking about punishing for lies. Free speech includes freedom to lie (with a few exceptions, like an oath, slander, libel). Anyway, where are you getting this from? I haven’t mentioned lying.

With incitement there will be borderline cases difficult to prove, but aren’t there always some? Nevertheless, it’s not impossible to prove. E.g. negative generalizations about ethnic/racial groups are pretty obvious. It becomes more complex with generalizations against religious groups, but again, analysis is possible.

Holocaust denial is lying. Bill O’Reilly’s speech was lying. The Rwanda Genocide was instigated by government lying. Selling baby parts in Planned Parenthood incited the shooting in Colorado Springs.

There are always cases in any crime that are difficult to prove.

The issue here is really stochastic terrorism. The person who does the inciting does not go punished. James O’Keefe’s video continues to motivate terrorists whilst James O’Keefe continues to stir up other people.

I don’t claim to be a free speech scholar. I did mention the slippery slope argument (if you criminalise this speech, then you can criminalise other speech).
