The second one is legal. The constitution specifically does not say the President has to have his hand on anything however the constitution does specify exactly what words to say. George Washington instituted the tradition of swearing on a bible but it is not in the constitution.

The first is also legal. This “controversy” is a non-issue and has as much significance as the legitimacy of the man’s birth certificate.
