Except Republicans wouldn’t be able to file criminal charges, it would have to be the US Attorney’s Office. And they’re not going to just go file charges without evidence (they are lawyers after all, many of whom probably want to be judges at some point), which means the FBI or some other law enforcement agency is going to have to conduct an investigation and present evidence that a prosecutor would find sufficient to convene a grand jury.
It would basically have to work exactly like it is now. And until we see how this plays out, we don’t really know what the end result would be.
Except, how many Republican State AGs would be thrilled at the opportunity to indict a Democratic President on state law charges?
