Why can’t people just use common sense? Don’t arrest kids for having butter knives, do arrest kids engaged in a brutal assault. Jeez, how hard is it?

Because lawyers and pressure groups, is why. The weakness of a policy that allows for judgement calls is that sooner or later a judgement call is going to be made that can be seriously called into question later. And then you don’t have a policy defense, which means you’re looking at a lawsuit likely to survive summary judgement. And then you are in serious trouble.
