Perhaps you missed this, but we were discussing not the merits of the Gawker case in isolation, but rather the larger implications of billionaires using the legal system to bankrupt publications and other entities they dislike. The MJ case is an example of such, and so is germane to the discussion.

If you want to have a discussion of whether or not Gawker was a bad actor in this case and this case alone, well, you can have that discussion, but the rest of us were not limiting ourselves to that.

Since you cannot exclude rich people from the legal system, the discussion is rather pointless. The only point worth discussing is what to do with the expenses, like the $600,000 you mentioned, in case the court case is found to be without merit. Since such was not the case in Gawker’s court case, there’s nothing further to discuss.
