i posted on this yesterday and repaste it here:

- just because the OLC says it’s ok doesnt make it legal. In this environment, with this AG, it’s almost, but not quite, like asking your own lawyer for permission.

- even if/when a president breaks a mold and does something that’s not been done before, that doesnt make it some unassailable precedent for all future presidents. (leaving aside IOKIYAR).

one reason is it could be a patent abuse of power the current DOJ refuses to challenge, but a future one wouldn’t (especially contra-party)

A second is that by that logic, whatever it is you are doing now/new is breaking with all the previous precedents, so it obviously has to work in both directions
