It is perfectly legal for the GOP to change how electoral votes are allocated in states they control at the state level. There is zero legal recourse against such ideas —- Nebraska and Maine already split their EVs this way.
The only restraining influence I can see is that a GOP victory won in that manner might well make the nation ungovernable, and that would be bad for business.
That might be the point. It’s easier to preach myth in a chaotic situation. People want to believe in anything that will bring order.
