The prosecution would have to show that the fear was one of immediate harm and that the shooter had done something to invoke that fear. In absence of eyewitness or video evidence, it comes down whether or not a jury believes the victim.

But the victim is dead. What can a dead man say? If that is the level of info that a jury can hear, than random murder is absolutely legal. And heaven help us all. And heaven help any person randomly walking through my neighborhood.

If you’ll excuse me, I’m gong to lock and load one of my rifles and randomly shoot whoever I happen to see. Who can say what my motivation is?
