Charles had some threads about it a while back. I cannot remember all of it but, maritime law is at play.

Probably something along the lines of, carrying weapons or soldiers means that the vessel is no longer a neutral merchant, and is at the mercy of the countries that own whatever territorial waters they may need to sail through.
