Darn it I have to run in a sec, but the POW rules could apply. Indefinite means until a negotiated release as in a swap or at a negotiated end of hostilities.
Until and unless they are declared a POW, those rules do not apply. So what - would it be more satisfactory to say “Charge, release, or declare them a POW?”.
Regardless until that time these people are simply in indefinite detention without charges. Very civilized.
