‘Unconstitutional’ is a big and scary word which got flung around with some abandon on the left during the two Bush Jr. administrations, and has now been picked up by the right during the past year.

Key thing here is, that’s not Romney’s call. That’s SCOTUS’ call, and if they get called on to voice an opinion in this matter, theirs will be the last word.

So, nu. On with the battle.

Unless and until a Constitutional issue reaches the Courts, it is absolutely a legitimate and proper line of political attack on legislation. I have no problem with such positions being taken, whether by the left or the right, so long as no one advocates that the law be flaunted so long as it is on the books.
