Yes, of course, but when the issue gets transferred into the Federal Courts, the DOJ loses control of the case. The FBI becomes an investigative entity that supplies supportive evidence through their investigations.

That’s what got the WH so freaked out. They no longer controlled the FBI and they had to can Comey.
