This is something DOJ lawyers know they are going to face occasionally. They still have an obligation to make the best arguments they can. It’s never a fun place to be (even being in private practice, I’ve been stuck in a spot where I’ve had to make arguments I didn’t really believe in), but that’s part of what lawyers are supposed to do in our system.

Of course, lawyers are also not supposed to lie or fabricate evidence, which may be a challenge for any honest DOJ attorneys under this administration. They are probably not provided sufficient information to make a coherent argument.
