FDR didn’t have to worry that a filibuster was the end of any bill. So long as support for the bill could outlast the lawmakers on Capital Hill, it had a chance at passing. Now, with the two-track system, one can kill a bill and yet the business of the Senate rolling along. You no longer need to stand up there and speechify for hours, you just need to convince 40 other Senators to agree with you.

They really do need to fix that, if you filibuster then you really should have to filibuster.
