I still don’t understand.

If the the AG decides they don’t want to file a formal charge, or if in front of a judge state that they wish for a case to be dismissed, what will the judicial system do, proceed without a prosecutor?

Consider me confused.

I thought the attorneys general, the ones under the AG, are part of the executive branch.

Don’t they have discretion on whether to prosecute or not?

An expanded version of my last response;

Yes, of course, but when the issue gets transferred into the Federal Courts, the DOJ loses control of the case. The FBI becomes an investigative entity that supplies supportive evidence through their investigations. Foghorn Gollum Leghorn, as the AG, loses control of the process.

That’s what got the WH freaked out. They no longer controlled the FBI investigation and they had to can Comey.
