Just speculating, don’t know if the 35 day stipulation is consecutive or cumulative per annum. Assuming consecutive they may be prohibiting using a short flight out of and back into the US as a trick to beat the 35 day rule. Can’t think of another reason. People go to extremes to find loopholes.

I don’t understand why that rule would exist.

If a person lives outside the country, then visiting in the country isn’t going to make a difference (and flying over it certainly doesn’t).

Someone living in Seoul and flying to Toronto (carried over US airspace and never landing here) is not avoiding the penalty on the ACA.

Moreover, US airspace includes things such as Pacific territories. Are they included?
