The Senate gets to make its own rules. It’s a shitty rule that should be abolished, but it’s not unconstitutional.

In this context, “constitutional” means “in the Constitution”, as in, the filibuster is considered a literal founding part of the Senate that can’t just be abolished by a simple majority vote.
