In that case the dealer likely is liable, but the manufacturer would not be unless it had sold it to the dealer and had a reason to believe he would not follow the law.

One thing to note is that “dealer” refers to someone holding a Type 1 Federal Firearms License (FFL). All FFL holders must keep a record of all guns they take ownership of and all guns that they sell. Type 1 FFL holders must also use the the instant check system called NICS to verify that the buyer is lawfully allowed to own a firearm. This is true even at a gun show.

Not if I’m a private seller, even if I call myself a “dealer.” So long as I’m selling this stuff from me to someone else, then I’m not required to do a background check or fill out any paperwork. Only time my ass might be on the line is if I suspect that the other guy would not otherwise pass a background check and would be legally barred from owning a gun. It’s the same loophole the straw purchasers in the F&F case used, paying guys who’d have no problem passing the background check to buy the guns, then “sell” them to cartel buyers who funneled them back to Mexico.
