She says it twice; the second time after the judge says, “factually legitimate,” which suggests she has no clue what she’s saying.

Facially is a legal term. I’m not an attorney (but I work for one), so grain of salt for me, but in layman’s terms here’s how I’d explain it:

Atty: “This is pie that everyone has to eat.”
Judge: “You’ve forcefully argued that it’s pie, but I’m concerned that it was baked by a lunatic and contains week-old raw pork, chewed gum, and garbage, held together with rubber bands.”
Atty: “Our argument is that it’s shaped like a pie, therefore it’s edible pie.”
