A president cannot pardon an individual until s/he has been convicted of a crime. Article II of the Constitution contains no language that grants an American president the power to grant a person a pardon before s/he is convicted. IOW, a pardon is granted only after someone has actually been convicted for having committed a crime. Pres. Clinton pardoned Marc Rich, but he only did it after Rich had been convicted.
