As we wait for the verdict to be read in the Jose Padilla Al Qaeda case, the Kos Kidz are feeling Padilla’s pain: Daily Kos: Verdict Reached in Padilla Case.

As soon as there’s a verdict I’ll post it in this topic.

UPDATE at 8/16/07 11:31:33 am:

Padilla and co-defendants are guilty on all counts. Maximum sentence is life in prison.

I don't really have a sense one way or the other how the jury will rule in this case. We'll find out soon enough.

I'd let Padilla walk. Put this guy back out there and follow his ass, tap his phones, let him implicate himself. It was almost impossible to get a conviction of this guy if the evidence to hold him all came from Pakistan. No way Pakistan was going to put their intelligence agents on the stand.

Then again, the President loses either way. If he lets Padilla walk he gets slammed. If he pursues the case he gets slammed.

Hopefully Padilla's attorneys did not make a mistake by not putting on a defense. Hopefully, the jury paid attention and were not swayed by the so-called circumstantial evidence by Dr. G (he's written a lot about Al Qeada). At this point, I hope Padilla is found not guilty. Whether he was truly plotting to explode a dity bomb or not does not compare to the fact that an American citizen was seized on American soil and held for 3 years without counsel or redress.

How can justice, in any form, come from this horrendous travesty? If Padilla is in fact guilty of some crime or another, the process of finding him guilty is so tainted by the injustices committed against his person that the verdict will be meaningless. And, as you said, the government will refrain from giving trials to anyone that it holds without proper evidence should it lose this case.

Bush is pushing a full assault on us now - fighting Al Qaeda in the Tora Bora mountains; throwing all his muscle into "the surge is working" propoganda; blasting us with spying methods directed at us; and lastly continuing to flame Iran to provoke war.

Of course, the AP report had to throw in the part about how Padilla was an enemy combatant held for 3.5 years before the switch into the standard criminal justice system. The charges provide a maximum of life.

Padilla and co-defendants Adham Amin Hassoun and Kifah Wael Jayyousi were convicted of conspiracy to murder, kidnap and maim people overseas, which carries a penalty of life in prison. All three were also convicted of two terrorism material support counts, which carry potential 15-year sentences each.

Sentencing will take place December 5.

As Malkin notes, here were the charges:

Count 1 - Conspiracy to Murder, Kidnap, and Maim Persons in a Foreign Country as part of a conspiracy to advance violent jihad
Count 2 - Conspiracy to Provide Material Support for Terrorists

That's disingenous at best. He was an enemy combatant who just so happened to be captured on entry in the US. It's a position that the US has rarely encountered before - the other possible similar instance is the infiltration of German spies in the US to sabotage US war assets. Those spies were captured and treated as spies - executed for their actions.

Putting Padilla in a military brig was appropriate, but apparently the Leftists wanted to put this in the civilian criminal justice system, and the wrangling over the case, how classified intel should and would be transmitted to the defense, jury, etc., had to be determined.

All that took time, and while this verdict was appropriate for the evidence, the military tribunals were probably the proper venue to deal with terrorists. They are in a better position to deal with classified intel and information than civilian courts.

Socialized medicine, much higher taxes, a bare bones military with lesbians in control, kos kiddies setting and controlling foreign policy, huge increases in entitlements and those eligible to receive them, "green laws" demanding that any vehicle above a mini would be illegal, EXCEPT for democrats, etc.

Then we'll find ALL of the loony left going on welfare, etc and Congress passing laws where Republicans, Conservatives and Christians were forbidden from going on welfare. This would be due to the fact that the new tax rate, 99.5% (but not for democrats, as the laws would be written to provide them a way of keeping their income) for income over $100,000 would be required to support the lefts new welfare state. Someone has to work to support those on the dole and it certainly won't be the left.

It's time consuming to think of the many ways the left would find to steal from the RIGHT and give so quickly to the left. A similar approach to chavez. But its time consuming for the RIGHT, but the ALL of the left would be at work, stealing from the RIGHT and giving to the left. I guess hitlery would change the name of Sec. of Treasury to Robyn Hood.

I have seen The Godess Kring too many times here in Seattle to be all to comfortable with a performance piece, although her long stares into the camera elicit a strange combination of revulsion and curiosity of why she just doesn't just put a bullet in her head and just get it over with already.

US Civil War...Lincoln held Southern sympathizers (US Citizens residing in the North) for Long durations during the war. I believe a sizable number for at least 3 years.

I didn't read the opinion and would be curious to see if the reasoning is persuasive. That said, the SC has been known to be spectacularly wrong before. We have very recent examples of that fact, actually. Trying times and circumstances, in particular, tend to lead to some of the worst decisions.

I believe there was legitimate concern that a Lynne Stewart/ACLU type attorney would have passed information between Padilla and al Qaeda sympathizers and agents not in custody.

I don't think that the government suggested that charges were forthcoming for those individuals and, unlike the present conflict, the Civil War was a confined conflict that, like the conflicts of the time, could reasonably be expected to conclude one way or the other in some reasonably foreseeable time frame.

Let me ask this ... if the government had held Padilla for another 20 years without charging him or giving him any normal legal recourse (and let's assume that the courts permitted this), would it still be ok? Assume, for the sake of the question, that the War against Islamism continued throughout that period with no end in sight.

The Supreme Court supported the 4th Circuit Court of Appeals ruling on this matter. Padilla's detention was not unconstitutional. They're the final word on the subject.

I'm no attorney so I have little knowledge, but don't you think extenuating circumstances and the scope of the atrocity if it had been successfully attempted probably led to a strategy by the Fed to get all its ducks in a row - basically determining exactly what they could charge him with and have a very probability of a guilty verdict?

If they had failed to get a guilty verdict, I believe that would have led to a precedent that had dangerous repercussions and that we are in new territory after 9/11.

To be honest, I can't remember a case like this so I don't know what would be involved. About the only thing I have to compare it to would be Moussaoui, the 20th terrorist.

The best that Jesselyn Radack can do is skirt the issues. Again, Padilla or his lawyers claimed “defensive jihad”; this is an admission of intent, and of guilt.


But there is a bit of reflection on the Left in general and the residents of Berkeley, CA, (specifically the residents that live in the Berkeley Hills, where there are no apartment buildings, or poor, and where the homeless do not go, because it takes too much energy), who spout off so much failed doctrine.

The reflection shows that the rest of America is tired of “their kind” of justice, and will now begin enforcing the sensible (and written) laws of the land.

He should be ... but he wasn't, AFAIK. I have said before that there is no good mechanism in our laws for stripping an individual of citizenship (and the Constitutional protections that should go with it). We need to have such a mechanism for those that choose to wage war against their nation. The fact remains, however, that he is a U.S. citizen who was held for years by our government without charges being filed against him. That is not a power that I want the government to have over U.S. citizens. If I am charged, I want the opportunity to confront my accusers and defend myself before I lose years of my life.

But many in this nation try to use laws that are used for citizens and common crimes and for wars between nations to defend these people, and they cannot pick and chose like that. But it was hardly a complete victory for the government. When Padilla was arrested in the months following the 2001 terrorist attacks, authorities touted him as a key al-Qaida operative who planned to detonate a radioactive "dirty bomb" in a U.S. city. That allegation never made it to court.

The White House thanked the jury for a "just" verdict.

The charges brought in civilian court in Miami were a pale shadow of those initial dirty bomb claims in part because Padilla was interrogated in a military brig and was not read his Miranda rights.

The key piece of physical evidence was a five-page form Padilla supposedly filled out in July 2000 to attend an al-Qaida training camp in Afghanistan, which would link the other two defendants as well to Osama bin Laden's terrorist organization.

I can't entirely agree with the enemy of my enemy analogy in this case. While their hatred of Bush is approx half the issue, remember that they hate America. Even if it was 9/11 Clinton in charge, they would still be saying the same thing. In their rotted minds they see America itself as evil. So the venom would be toned down slightly, but would still be there. Even if he had been through a normal criminal trial as a U.S. citizen and convicted the Koslims would still be angry. Well , we AS AMERICANS AGREE THROUGH THE CONSTITUTION TO ABIDE THE RULINGS OF THE SUPREME COURT ...and the supreme Court has given it's ruling and the traitor given his DUE PROCESS ...not only that , but was tried by a Jury of his PEERS - verdict ? GUILTY AS CHARGED...so stop your whining and handwringing and that bullshit about "a straight and narrow path " that is what the Supreme Court exists for , to interpret the Constitution and reach a consensus ruling as it applies to the case of Padilla by which we , as American have pre-agreed to abide by , rather than riot as is done in many other places .
So climb down off your self-righteous podium and face reality , it is GOOD that this country cannot be screwed by so rigid a system of law that the law itself is used as a weapon of destruction by it's enemies .
In fact in Padilla's case, this Great System of Justice worked admirably , given the FACT , that we are indeed at war ...and padilla chose to be an agent of our enemy , or hadn't you noticed ?
An enemy combatant gets the advantage of due process for no other reason than he is a citizen , and instead of a milittary tribunal , the advantage of Civil Law . And according to the Supreme Court , it was done right .

No, and your suggestions are gibberish.

The Supremes ruled that Padilla had filed in the wrong court. To say that the Court "kicked the case back down to the Civil level" makes no sense for several reasons: (1) all habeus petitions are "civil" in nature; (2) Padilla's case was dismissed, not remanded; (3) cases can't be appealed from the highest Court "to the next circuit," and this wasn't an appeal in any event; and (4) if the Court had ruled as you earlier implied it had, i.e. that the Gov't had acted properly in detaining defendant without due process, that would have concluded the matter.

In other words, you couldn't be farther off base.

Think before you speak [and insult ] .

And uh , yea ...checks and balances , 5th grade civics bumpkin .

I think not!

Padilla helped dig the remains of his al Qaeda buddies from the rubble of their destroyed safe house (Padilla was out at the time learning from the “Explosives Expert”).

Padilla, who was with the Explosives Expert at his safe house when Atef’s safe house was bombed, admits he returned to help dig Atef’s body out of the rubble.
