Rather Sues CBS for Damaging His Reputation

Dan Rather, who was the stooge in a plot to tilt a presidential election with phony documents, is suing CBS for $70 million, and still insisting the documents weren’t proven to be fake.

Dan Rather, whose career at CBS News ground to an inglorious end 15 months ago over his role in an unsubstantiated report questioning President Bush’s Vietnam-era National Guard service, filed a $70 million lawsuit this afternoon against the network, its corporate parent and three of his former superiors.

Mr. Rather, 75, asserts that the network violated his contract by giving him insufficient airtime on “60 Minutes” after forcing him to step down as anchor of the “CBS Evening News” in March 2005.

He also contends that the network committed fraud by commissioning a “biased” and incomplete investigation of the flawed Guard broadcast and, in the process, “seriously damaged his reputation.” As plaintiffs, the suit names CBS and its chief executive, Leslie Moonves; Viacom and its chief executive, Sumner Redstone; and Andrew Heyward, the former president of CBS News.

It wasn’t the investigation that damaged Rather’s reputation. It was his own actions ... and this:

dan would know bias, now wouldn't he? Interesting he didn't include Ms. mapes as having damaged his reputation, since some simple fact checking would have prevented all of this.

As I pointed out in the other tread, CBS deliberately did NOT can Rather immediately precisely to protect his reputation.

CBS is the victim of Rather here, not the other way around.

And I'm sure Rather doesn't really expect to win this suit, he's just trying for damage control on his own reputation.

I really can't see him wanting to revisit this carefully under a media microscope and cross examination at trial.

Look's like the NYT is the only source on this that I can currently find. Let's break this one down.

He was provided with very little staff support, very few of his suggested stories were approved, editing services were denied to him, and the broadcast of the few stories he was permitted to do was delayed and then played on carefully selected evenings, when low viewership was anticipated

Now was this before or after Rather Gate? It doesn't specify.

Mr. Rather quotes the executive who oversaw his regular segment on CBS Radio, telling Mr. Rather in November 2004 that he was losing that slot, effective immediately, because of “pressure from ‘the right wing.’ ”

Look how fast they lay the blame on the Right Wing for catching an entire network backing a fraudulent story.

That's why CBS, like other news organizations, employ "fact checkers" -- like disgraced producer Mary Mapes.

Dan Rather = Loser.

This is wrong on so many levels. As you say, it was up to Rather to prove they were NOT fake, not the other way around.

But just as important Rather wasn't canned because he went with fake documents.

He was fired because of his stonewalling, denial, and wild accusations long past the point of reasonableness after legitimate questions were raised about the authenticity of said documents. The other networks (which usually let each other slide on stuff like this), were starting to ask "What the hell is wrong with Rather"?

Had Rather simply admitted on day 2 (or maybe 3) that he'd been had or likely been had, he'd still be sitting at the desk at his old job and nobody would be talking about this. It wasn't the error that did him in, it was the disgraceful manner in which he handled the error, transparently compromising his appearance of integrity.

That's why he got fired.

"What's the Frequency, Kenneth?" refers to the question one of two unknown assailants (one later identified as William Tager) asked CBS anchorman Dan Rather while assaulting him on Park Avenue in Manhattan in October 1986. The phrase Rather reported actually hearing was "Kenneth, what is the frequency?"...R.E.M. vocalist Michael Stipe said of the incident: "It remains the premier unsolved American surrealist act of the 20th century. Appellate Court Presiding judge Laurence Trébucq has demanded that France 2 hand over the 27-minutes of raw footage shot on the afternoon of September 30, 2000 by Talal Abu Rahmeh. France 2 lawyer Maïtre Bénédicte Amblard tried to convince the judge that the request was not appropriate, relevant, necessary or even advisable. But the judge wants to see the outtakes with her own eyes. This is the first time the French court has made such a demand that would be normal in the US system. The court will now be able to determine if the Al Dura shooting and tape was a fake, as many have alleged.

Maître Amblard was not able to reach her clients to confirm availability of the footage. Today’s hearing was adjourned. The next hearing is scheduled on November 14th... to view the raw footage.

The answer to the question, unfortunately, is that the quantity of Rather's career bullshit is unknowable. He probably got away with lots of stuff in the past, simply because nobody could even mount a challenge.

I really think he fell this time because the internet (ie Charles/LGF) provided a fast, widely disseminated response. The throbbing memo speaks for itself, and louder than Rather's bullshit. Its an image really worth 10,000 words.

Honestly, I don't think he's that stupid. In his heart he knows they're fake, he just refuses to admit he's been had by a not only a fake, but an abysmally poor one. His professional pride won't let him admit he was had by a con that bad and that his career was ended because of such a juvenile stunt.

And his claiming they haven't been proven to be fake is disingenuous. They have absolutely been proven to be fake, and I believe that proof would hold up in civil court, if that's the standard of "proof" you'd care to use.

We're still waiting for the magical typewriter that made that memo in the 1970s to appear, and we're still waiting for any other authenticated memo of similar appearance from that era to appear.

The next question is, did he know they were fake at the time he ran the story?

I'm actually willing to give him the benefit of the doubt on that one. In my opinion, his ideologic blinders probably prevented him from seeing that. He wanted to believe the memos were real, so he believed they were real, or at least likely enough to be real that he was willing to run with them, despite the fact that they obviously required more vetting.

The last question is, did he even suspect that they could be fake at the time he ran them (obviously he did later)?

I really don't know the answer here, but again, I think his ideologic blinders trumped his judgment.

He was a fool to report on such a flimsy story, he did so thinking he could influence the election. And in that he was successful, anyone over the age of forty knew those memos were fake, we all had typing classes in the 11th grade and we knew what the text looked like.

Lately he has been asking people to "prove that the documents are fake." Don't take the bait, it is impossible to disprove an unproven hypothesis. Let him prove they are real. That is the task.

One thing that seems to have dropped off the 'radar' is the kerning issue. NO typewriters at the time (only professional publication presses) would perform this.

Kerning is where if you have an overlap such as a Te the left side of the 'e' actually is 'inside' the 'T' block of area, effectively the far right side of the T is overlapping the far left side of the e. This is evident in the documents, so unless memos were being sent to professional publishers, it doesn't matter which typewriter the memo was supposedly written on, the document shows kerning, which means either a computer word processor such as Word or a professional publishers press.

Given the high level of matching with Word formatting, taking these two issues together nullifies the 'advanced' typewriter argument. Memos about soldiers are not sent out for professional printing. So that leaves us with faked on a system that didn't exist at the supposed time of the memo.

I understand the kerning issue is quite technical, however, its is the 'smoking gun' here that eliminates all the 'well the IBM model xxx could do the formatting that we see here' arguments. This needs to be pointed out repeatedly and hopefully comes out during the trial.

What was it that Steyn wrote about Rather when he was still defending the authenticity of the documents? "Hello? Earth to the Lost Planet of Ratheria?"

No doubt Rather is hoping for a quick settlement in the hope that CBS will not want to get into a grudge match with its former glamor boy. However, this is different from the Imus situation. Imus had a contract which stated that he was hired to perform a show that was to be "edgy" or "controversial" (or words to that effect). By firing him for doing what exactly what he had been hired to do, CBS breached his contract and was obligated to pay him.
I bet Rather's contract does not obligate him to falsify news stories....and that report was far more kind to Rather and Mapes than it should have been, as had it stated the obvious conclusions, CBS would have opened itself up to even more litigation.

And yes, as noted above, it is the job of a journalist to authenticate a story before running it, not the obligation of others to "prove it false."

Well, I disagree here. This depends on what standard of proof you want to accept, or what you consider "proof"

It could be quite possible to absolutely prove these are fakes, if say, the hoaxster who made them confessed and even provided evidence of the fraud. Conversely, if they were authentic, it would be trivially easy to prove that too. . .just produce the originals and compare to documented existing memos from that time.

Obviously, these things aren't going to happen.

Regardless, I still think this issue is provable, in a way that most people would accept. (The throbbing memo is proof all by itself).

If you put the issue of the documents authenticity in a courtroom in front of 6 (or 12, whatever) jurors, and had both sides of the "issue" present their evidence, with the jury deciding whether or not said documents were legitimate, I think you'd have a legal "proof" of sorts, that most people would accept.

I also think that if you did this, Rather wouldn't be too happy about the outcome, and interestingly maybe this will actually happen!

Frankly, there is tons of evidence proving these are fake, and I don't think Rather can adduce one scrap of evidence to prove they are anything other than a clumsy forgery.

Rather and Mapes have had 3.5 years to come up with:

a. A machine from the 70s capable of producing the so called memo, or
b. Another authenticated memo from the 70s with identical typeface.

And they haven't done this.

In fact, as far as I can tell, they haven't come up with ANYTHING that supports the authenticity of these memos.

Meanwhile the other side has the throbbing memo (all by itself absolute proof the memos are fake), and a poor match with documented memos from the time, both in word choice as well as typeface and paper size.

Its game, set, and match. There is no controversy here. The memos ARE fake, and at this point is like Holocaust denial or Trutherism. If you don't want to believe the evidence of your own eyes and common sense, there is nothing left to convince you.

I totally agree that they are fake. However the kerning issue puts to bed even the 'theoretical' typewriter they claim could have done it, it removes reasonable doubt completely as even IF that high end typewriter had been available for a simple secretary/assistant/aide even it could not have done the kerning.

That's my point with the kerning mention and why I hope it's not just sidelined.

I agree the onus is on Rather / etc. But even if they make the 'well it could have been done on this typewriter' that's shot down by the kerning. Leaving them having to make the argument that the internal memo went to a professional printing house at the time, like a large book publisher.

I could respect dan rather and even jason blaire a lot more if they just stuck with reporting the facts and when they have the facts wrong, they admit it and roll with the punches.

Rather may well have been someone's unwitting patsy but the man should have come forward with who, what, why and where. If someone put the screws to me at work, I sure as hell wouldnt go quietly into that dark night then turn around a year and a half later and sue because I didnt get an assignment I wanted. I'd leave a bloody streak down the backstabbers face. Maybe rip off an arm.

I love Blather's argument that the docs were never proven false (as thought they weren't). Even since he's too stupid to see that they were it speaks volumes that his standard of truthfulness is whether something can be proven false not whether it can be proven true.

There's a big difference between making an honest mistake and engaging in unethical conduct. In the former, an apology is natural and typically accepted. In the latter, the first three things that come to mind are to deny, to deny, to deny.

Rather did not make an honest mistake. He wanted to impact the elections and got caught.

One thing I saw mentioned very seldom was the STYLE of the fake letters. Believe me the USAF has only one way to do things, and that is by the manual. In this case the manual is AFP 13-2, Tongue and Quill. This is the style book the USAF uses for ALL written material.
There are so many things wrong with those letters or memos. If you are used to the style the AF uses you could see in an instant that these letters weren't written by a USAF member.

Although I initially thought his law suite was good news (another chance to make him look foolish), now I'm not so sure. What if his lawyer has shopped around to file suit in a district where he is likely to get a judge and/or jury biased against Bush? What if he's made a deal with the CBS where they protest for a few weeks, then quietly settle (for much less than Dan's asking price) and agree that they fired him under pressure from the White House?

Maybe I'm being paranoid, but somehow I don't expect a fair trial here...

The "fake, but accurate" memo was to show that W shirked his duty in the Texas ANG. It's my understanding that to fulfill one's enlistment in the Texas ANG one has to earn so many credits. Apparently these corresponded to months of service, for a standard amount of time (48 hrs?) each month. 60 is the number I recall reading that one had to earn as a non-pilot to fulfill one's commitment. Since Bush trained to be a pilot, he earned over 300 credits and risked his life repeatedly when he flew. Can someone confirm this credit system and how many credits a TANG pilot typically earned during his enlistment? If this credit system is basically accurate, what is Dan Rather accusing Bush of? Missing 3 or 4 required credits out of over 300?

Let them have at it. Now Jesse Jackson says Obama's actin' too white. First generation African, but too white-ish for the likes of Jackson. Does that translate to too educated with a nice accent?

The culprit in this case is the person who created the forgeries and passed them on to Mapes to give to Rather. Why isn't Rather trying to find the real culprit, instead of just more of the same pretending that he still doesn't understand what much of the world knows: the documents were forgeries. They were made using modern technology, but pretended to be old documents; in other words, they were forgeries. Why is Rather unable to understand that? Why does he go on and on using his same false assumptions?

Why would discovery be particularly embarrassing? Not that CBS doesn't have plenty to hide, but they'll be the ones doing the digging. I assume, they'll just use and release only the smallest possible amount needed to win the case. All the truly great piles of stinking waste matter will just not reach the public's nose. After all, the more they harm Gunga Dan, the more they harm themselves.

Based solely on the level of Rather's unshakable refusal to acknowledge the most obvious fraud since the Hitler diaries, my spidey sense is telling me that his daughter had something to do with the documents' creation and "authentication."

I'm sure he woud be more than happy to feed Burkett and Mapes to the wolves to save his own skin, but his daughter may be tied up in this as well. She was part of the Texas Dem conspiracy group at the time:

Travis County, Texas, District Attorney Ronnie Earle, who exploded upon the American scene as a result of a grand jury indictment against Republican House Majority Leader Tom Delay, is a known partisan Democrat in Texas. His history of trying to prosecute Republicans such as Senator Kay Bailey Hutchinson also is widely known in Texas. The Senator Hutchinson case was thrown out when Earle admitted he could not prosecute the case due to insufficient evidence which in legalese means he had no case. His attempt to do the same thing to Bush campaign consultant Bob Bullock also failed when a grand jury refused to indict Bullock.

The tough, tenacious Ronnie Earle often boasts of his close relationship with former Texas Governor Ben Barnes and Robin Rather and they are listed as supporters and contributors to his reelection campaigns. Barnes is the man who on CBS's 60 Minutes told newsman Dan Rather he pulled strings to get President Bush into the National Guard, and Robin Rather is Dan Rather's daughter, a Democrat activist in Texas. The former CBS anchor is suspected of working closely with the Texas Democrat Committee and in fact it was Texas from which the famous Rathergate forged documents emanated. Rather was forced to resign from CBS after bloggers exposed his prima facie evidence against Bush as a fraud. And Dan was a guest speaker at a Democrat fundraiser for none other than Ronnie Earle.

How could she not be involved with this? It would explain a lot. Maybe she was even Lucy Ramirez...
