-RetweetNY Passes 'Libel Tourism' Protection Act

Wed, Apr 2, 2008 at 9:44:51 am PDT

The Democracy Project has good news from New York, where the state legislature has passed a law to protect writers from being sued by Islamic billionaires.

Saudi billionaire Khalid Salim Bin Mahfouz, who successfully sued Cambridge University Press last July, has failed in his efforts to silence Rachel Ehrenfeld.

The American Center for Democracy in Defense of Freedom, which Ehrenfeld directs, has just issued the following press release. The New York State legislature today passed the “Libel Tourism Protection Act,” which will help protect American writers from the likes of Bin Mahfouz, who uses his millions to silence critics of his own past and of others who work to spread Wahhabi Islam around the world. For the likes of Bin Mahfouz, the inability to convince people of the merits of your arguments leads instead to efforts to sue them into silence. That underhanded assault on our freedom of speech has now become more difficult, as this new legislation corrects holes in New York’s law that had left Ehrenfeld, and other authors, open to suits from foreigners like Bin Mahfouz.

17 Occasional Reader  Wed, Apr 2, 2008 9:52:28am
Dr. Ehrenfeld sought a court order in November of 2006 to protect her constitutional rights, but in a ruling with national First Amendment implications which sent legal shockwaves throughout newsrooms across America, as well as potentially undermining our ability to expose terrorism’s financial and logistical support networks, the New York Court of Appeals ruled that it does not have jurisdiction to protect Americans – on U.S. soil – from foreign defamation judgments, which contradict the First Amendment to the United States Constitution.

Bizarre. Basic "black letter law" in the US has always held that foreign judgments that contravened basic US legal protections would NOT be enforceable.

Kosovo: Serbia probes human organ sales

Belgrade, 27 March(AKI) - Serbia is investigating reports that Kosovar Albanians [ Muslims (ed.)] have been selling human organs of kidnapped Serbs [Christians (ed.)] to western countries, including Italy, since the 1998-99 Kosovo-Serbia conflict.

The Belgrade Daily Press said on Thursday that a protected witness, known as K-144, had made the allegations to the former chief prosecutor of the International Criminal Tribunal for the Former Yugoslavia (ICTY), Carla del Ponte.

According to the International Red Cross up to 3,000 Serbs have been reported missing or killed since 1999 and 200,000 fled the province.

The paper said the Serbs kidnapped by the Kosovo Liberation Army (KLA), were transported to northern Albania where their internal organs were allegedly removed and then sold in Italy and western countries.

The KLA was a paramilitary guerrilla organisation that sought independence for Kosovo from the now defunct Yugoslavia and later Serbia in the late 1990s.

The plan is to essentially set up EZ Pass gantries on the East river Bridges and at the Avenues leading into the area. Mrs. Lawhawk pointed out last night that the hundreds of millions spent on installing the system, which will probably cost more than they're envisioning could be better spent on actual transportation projects and not on another bureaucracy. I agree. More on congestion pricing here. As I repeatedly point out, it's simply another way to impose a tax on people in the NYC Metro area, and it will not accomplish what they're setting out to do in any event.

Arghh - that was not so cool - making fun of blind folks isn't my idea of "humor"!

Reminds me of many years ago on the Grammy awards, where Stevie Wonder was getting some kind of award. He was somewhere in Africa on tour, and they had him on the awards show live via satellite, and the Grammy host or presenter (don't remember who that was) kept saying, "Can you see me, Stevie? Can you see me, Stevie?". Uh no, I don't think he could.

re: #96 joncelli

Use an EasyPass-like arrangement -- when you pass a certain bottleneck, they interrogate the electronic device you should have in your car (on pain of a large fine), which directly deducts the amount from your bank account. You get your picture taken if you just drive through without paying. And yes, it'll be a PITA, I'll bet.

Ok, I have EasyPass. What if I have to cross the electronic device more than once during the day, or as it usual in NYC, I have to circle a block thus encountering said device more than once? I bet all the restaurants and stores in china town and little Italy are gonna love that?

I think you've slipped overboard re this shooting. Reading the news article it applies to the questioning of the person after he asked for his lawyer. This will not rule out any eye witness testimony, etc., that the cops have independent of the interrogation.
Secondly, I think you're way outside on your comment, that because of this interrogation and the judge's ruling, Jews could not be safe nor treated justly.
I can understand, somewhat your concern over this guy even remotely getting off, but it appears that you've greatly exaggerated the particular issue here and the risk of this as evidence or rising antisemitism.

I got caught speeding in Wshington, DC by one of those cameras a couple of years ago. I coughed up the money.
Later a friend told me I shouldn't have, because CARS don't speed, DRIVERS do...and there was no way you could tell from the photo whether I was the one driving. Any thoughts on that?

I didn't see if it was retroactive in the article. If not doesn't Rachel Ehrenfeld still have to pay? I mean she does have a judgement against her and she lost the appeal.

I'm not attny but - NY courts will determine its enforceability. I don't believe it's a retroactive issue. If the judgment is unsatisfied it will remain so. Assets outside the US are still vulnerable.

The Libel Terrorism Protection Act declares overseas defamation judgments unenforceable in New York unless the foreign defamation law provides, in substance and application, the same free speech protections guaranteed under our own constitution, and it gives New York residents and publishers the opportunity to have their day in court here in New York.

Heh. My favorite story regarding red light cameras is from Bolingbrook, Illinois. The village placed red light cameras at several busy intersections. People complained about them going off when they were turning right on red. The complaints were ignored. Then, the mayor, Roger Claar, was caught by one of the cameras. He paid his fine, but the camera program was suspended indefinately, immediately. Fishy, no?

$8 per car entering Manhattan south of (I think) 86th Street.

If you enter via a toll crossing you will pay your toll plus the remainder of the fee.

So, since the Lincoln Tunnel is $8 for the RT, I think $4 more is taken out of your account.

What a Maroon he is.

It's $8 for the day, regardless of how many trips into the zone. Expect lots of computer glitches as they screw up how many times you get charged per day. And, all it will do is shift congestion to those neighboring areas - just north of 60th street (watch how much traffic jumps off the West Side Highway at 79th street clogging West End Ave and Riverside Drive, not to mention the FDR Drive and all the areas around the bridges and tunnels - with drivers looking for places to stash their cars to avoid the toll. Yeah, unintended consequences that will play havoc with the commutes of hundreds of thousands a day.

Oh, and did I mention that the subways are already maxed out on some lines and can't handle additional passengers, and the improvements promised in March have already been revoked claiming no money to implement them. Promises made and broken. It's a broken record.

And even Bloomberg admits that he can't promise what will happen to congestion pricing revenue after he leaves office. Yeah, what a bargain.
