AZ Gov. Brewer’s Crusade to Deprive Gays of Health Insurance

No state exemplifies what happens when wingnuts take control as much as Arizona, where right wing Gov. Jan Brewer is now asking the Supreme Court to let her take away the health insurance of state employees’ same-sex partners.

Arizona Governor Jan Brewer (R) has requested that the Supreme Court overturn a ruling that allows state employees to keep their same-sex partners on their benefits, including health insurance.

Brewer filed a petition for a writ of certiorari on July 2, requesting that the high court overturn the United States Court of Appeals for the Ninth Circuit’s September 2011 ruling in Diaz vs. Brewer. The pushback comes three months after the Ninth Circuit denied a request by Arizona state lawyers to re-hear the case with an 11-judge panel.

Last September, the Ninth Circuit’s ruling prevented Arizona from implementing a law that would have barred state employees’ same-sex partners from remaining on their health plans. The ruling affirmed a lower court’s decision to place a preliminary injunction on the law.

I don't know anything about this case. But I am fairly sure that Arizona is not one of the (few) states that prohibits discrimination based on sexual orientation. How much contact does Governor Brewer have with Arizona's state employees? I have to wonder how many of these state employees with same-sex partners she personally knows. If she stopped to think about it (not necessarily something she would do), she might wonder if people she works with, or people whom they know, are state employees with same-sex partners.

I have no idea where Gov. Brewer works most of the time, or whom she interacts with from day to day, but it seems odd that she's crusading against precisely those people whom she's either likely to know personally, or people she knows are likely to know personally.

Okay, the legal reason she's (Arizona) claims in pushing ahead with the appeal to the US S.Ct. is that the Ninth Circuit misconstrued the Equal Protection clause.

The relevant part of the 14th Amendment:

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Considering that the courts have construed this to require extending benefits for same sex partners, she's looking to narrow the Equal Protection clause so it doesn't apply to gays and lesbians.

She's hoping to get the S.Ct. to overturn the 9th Circuit. Procedurally, the 9th has looked at the issue twice. First as a 3-judge panel, and the second time, it refused to look it at a full-11 member panel. The 9th had upheld the trial court's ruling. The S.Ct. has until August 9 to issue a response on cert. Brewer v. Diaz Dkt No 12-23.

The 9th Circuit had found that the AZ law would have been discriminatory on a rational basis (the lowest level of review - strict scrutiny being highest):

In sum, the district court correctly recognized that barring the state of Arizona from discriminating against same-sex
couples in its distribution of employee health benefits does not constitute the recognition of a new constitutional right to such benefits. Rather, it is consistent with long standing equal protection jurisprudence holding that “some objectives, such as ‘a bare . . . desire to harm a politically unpopular group,’ are not legitimate state interests.”

But the wingnuts can't seem to make up their minds whether he's a traitor or that he was "forced" to vote contrary to what they expected. The latter reads pretty much like desperation, some vain hope that they can "prove" that Roberts was forced by Obama into ruling ACA constitutional.

As I read the opinion, I think the law that is at stake was signed in 2008 by Governor Napolitano - to expand the definition of the term "dependant" to include qualified domestic partners, who could be of either sex.

I think the current AZ administration wanted to eliminate the cost to the state of offering coverage to domestic partners as a whole, and did so in 2009 by redefining "dependents" as spouses or children below a certain age only - thus eliminating all domestic partners regardless of orientation.

I think the district court ruled that the elimination of domestic partner coverage was not discriminatory on its face, but that it had a discriminatory effect in Arizona because opposite-sex domestic partners can get around the change by marrying, whereas same-sex partners cannot.

Earlier this year, a virus infected millions of computers around the world that caused the infected computers to visit fake websites and prevented owners from visiting security websites to remove it. In an effort to stop the virus, the FBI set up several clean servers so that those infected would still be able to access the internet and remove the virus from their computers.

The FBI's efforts were only temporary and today the clean servers it had set up were scheduled to be turned off and therefore any person with an infected computer that had not gotten rid of the virus by today risked losing access to the internet.

The Actual Live-Action Akira Script: Worse Than You Think

Every once in a while we'll kick off a movie parody by saying "so we got a hold of the script" and then we make up a bunch of stupid crap, because we're giant man-children. But this time it's for real: Some poor, confused soul saw my column last week, about the ill-advised Akira live-action remake, and they sent me the actual, real script for the film. Again, and in no uncertain terms: I did not write the following script excerpts. They are not parody or fiction.

I have every reason to believe this script is authentic, but I do not have confirmation from the studios. If it is real, this script is the thing that pulled the movie out of Development Hell, where it had been sitting for decades. This is the script that finally got Hollywood to stand up and take notice. This is the script that made studio executives bolt out of their chairs and say "yes, we have to do this!" And it's easy to see why: Nearly every aspect of the film has been altered to fit the most tired, hackneyed, bullshit Hollywood cliches in existence. As low as your opinion of this production might have been, the script proves one thing: Even if you have to dig the damn hole yourself, there is always a downhill.

Before we start, I'd just like to say two things:

One: This script is ostensibly the version just before the infamous whitewashing, where they changed Tetsuo's name to Travis.

Two: I can't believe somebody actually sent me a script. In the big book of "People Who Matter in the Entertainment Industry," how the hell did you land on my name? Did somebody scribble it next to "for a good time call"? Hahaha, how filled with regret are you, right about now? Like on a scale from 1 to 10? Is it a 10?

I hope it's a 10.

First, I'll admit you and I disagree here.
Your answer is in their decision, which I respect. I happen to think it reasonably clear that mandates are a power left to the states. And withheld from the Federal gov. Of course the power to tax is far more clear in the affirmative. The commerce clause (too broad IMO, decisions I disagree with but respect) has muddied the legal waters on the mandate AFAIK.

To me we got the best possible decision. But we likely disagree there too.

I can think of better ways to get it done. Like an all ages medicare buy in option. But the powers certainly don't ask me about anything. So that's moot apart from trying to project my wishes on the matter.

NRA isn't always just speaking for gun owners. The other aspect of the NRA is to lobby for gun manufacturers and their interests which includes international sales. Any obstacle to those sales such as arms treaties obviously would have an affect on profits/revenue.

I'm not really disagreeing with you on the outcome, more with your assertion that the justices (both the SC and more generally the justice system) don't wield partisan political power.

I think their partisan influence is, in fact, substantial. In my own field Republican-appointed justices have led to the virtual elimination of affirmative action. I think you can make a strong argument that their efforts have met with greater success than attempts to accomplish the same through legislative means.

So you do accept it. And now you move on to the second stage, whereby you try to minimize the nature of the NRA's opposition to the treaty.

Of course, the treaty isn't perfect, and of course there will always be people trying to work against the system. But the fact is that the treaty is designed to reduce the flow of weapons to places like Sudan, DRC etc. And the NRA opposes it.

If/when the UN has a treaty that seemed by some reads to impact our 1st amendment I think we would see a more broad reaction. The 2nd is easily the least popular of the early amendments. Easily the least supported outside us gun owners and right leaners.

Sam Sparks, of United States District Court, chastised Armstrong’s lawyers for submitting an 80-plus page complaint filled with allegations that “were totally irrelevant to Armstrong’s claims.” Sparks said the court was left to presume that the lengthy list of allegations “were included solely to increase media coverage of this case, and to incite public opinion against” the antidoping agency and Travis Tygart, the agency’s chief executive who is also named as a defendant.

“This Court is not inclined to indulge Amstrong’s desire for publicity, self-aggrandizement or vilification of Defendants, by sifting through eighty mostly unnecessary pages in search of the few kernels of factual material relevant to his claims,” Sparks said.

The judge added that Armstrong could refile his case within 20 days, but only if he limits his pleadings to information that is legally relevant to his case.

"They have no right to military health care and the military services have total discretion in when and under what circumstances retirees and their dependents will get care in military treatment facilities," the report said.

Yup, that was settled as a legal issue a decade ago, and the active duty soldiers know it. The may be treated (and usually are, or included in the TriCare insurance program). They never really had the legal right. For the record, Fed employees retired with the 'gold-plated' health insurance are also bumped into applicable Medicare parts on reaching 65.
