Here’s Chuck Johnson’s Ludicrous Lawyer Letter to Twitter

As we mentioned in our previous article, Chuck Johnson has now been suspended five times by Twitter, and his original account with more than 25,000 followers (@ChuckCJohnson) has been permanently banned.

Chuck is definitely not a happy camper about this, and he’s raging like a loon with his latest serial account (@freechucknow) and threatening to sue Twitter. Yes, really!

Via David Holmes at PandoDaily, here’s the utterly absurd letter Chuck Johnson’s lawyer sent to Twitter today. Among other ridiculous and risible points, Chuck and his lawyer are actually making the argument that Twitter owes him the right to use their service to make money.

It’s a completely frivolous case, and Chuck is very obviously praying that Twitter will cave in before they have to take it to trial — because if it goes to trial it will be immediately tossed out in a summary judgment, and the lawyer must know this. I predict Twitter will just ignore this nonsensical threat.

Up until very recently, I could have pulled some shit and gotten my driver’s license suspended and wouldn’t have been able to make a living. I would have had no recourse against that. As my old boss used to say, “It’s all fun & games until we get to the discovery phase and start noticing depositions. They show up with their little indignant lawyer, look across the table, and see me and four associates, and three paralegals. We mention that the loser of the case has to pay the court costs, and that we’re currently billing at $1,000 an hour for me and $400/hr for the associates, $90/hour for the paralegals. And that each hour of deposition requires probably three hours of analysis from each of us. And that we have a couple of 8-hour days ahead of us. For this deposition, which is the first of about 20 that we’ve noticed.”

Twitter can write these kinds of legal costs off on their taxes. On the other hand, CCJ’s lawyer will either 1) freak out when he gets carpet-bombed by Twitter counsel and recuse himself or 2) demand ever-higher retainers out of Chuckles until he milks him dry, because he’s an amoral shyster, and then bail on the case because Chuckles has no more money to give him.

And yes, as far as trying the case on its merits, CCJ is about to find out that he’s playing in the big leagues Without A Fucking Bat.

Wouldn’t a real lawyer advise his client to stop it with the Tweets further threatening the company they are trying to sue to come to agreements to be reinstated?

There is just too much Chuck in this whole show for any of it to be anything but Chuck.

And it is painfully obvious for the whole internet to see…Chuck has probably never been told “no” very much. Dude is going off like a 2-year old in the toy isle that wants that bird doll that tweets and no one is going to let him play with it.

The preferred (default) DNS services that your ISP pushes to your router may be … suboptimal. Or worse, they could be altered/compromised in your router by malware. You should be aware that it is your option to customize those. Better yet, try explicitly setting your preferred IP addresses for DNS services within the properties of the device in your computer (ethernet or wifi adapter) that handles your internet connection. That machine would then not even care about the DNS settings that your router and/or ISP offers.

I wouldn’t say “his words clearly implied” because he often times seems to have no idea what he wrote really means. He can never seem to clearly imply his meaning.

So, why the words mean exactly how you stated them, he may never have been intending to say he paid for anything. He may have meant because the article was about him, the illustration is his…because.

This is Chuck. An interpreter is always needed. I think he is counting on that being one of his Twitter defenses.

I wouldn’t say “his words clearly implied” because he often times seems to have no idea what he wrote really means. He can never seem to clearly imply his meaning.

So, why the words mean exactly how you stated them, he may never have been intending to say he paid for anything. He may have meant because the article was about him, the illustration is his…because.

This is Chuck. An interpreter is always needed. I think he is counting on that being one of his Twitter defenses.

I know most of you don’t care, but since this happened to my account it’s kind of fascinating to me. My best guess right now is this.

I was up late when Chuck made the tweet that eventually got him suspended. I saw it immediately and reported it as a violation within minutes. Not bragging, but it’s probable that my report was one of the first. At some point after Chuck’s account got suspended some kind of glitch may have triggered that tagged tweets I made mentioning @ChuckCJohnson with a kind of internal use diagnostic flag that Twitter’s engineers use with internal accounts when they’re testing new features and don’t want the test tweets to be seen outside of the testing account.

I don’t think it was purposeful at all, just a bug in the system.

What I just don’t get is that he was doing the exact same bullshit the other three times they slightly slapped him on the wrist. I realize Dick Costolo had that supposed come-to-Cthullu moment a few months back about actually giving a shit about the abusers on his service, but goddamn; this shouldn’t have taken as long as it did.

I really believe that they only took action because the threat was against Deray. He’s too high-profile (and generates too many clicks for Twitter) for them to risk pissing him off and having him move to another platform.

What probably stopped taking action in the past - that Chuck was generating traffic - finally ended up working against him.

Twitter, if nothing else, knows upon which side their bread is buttered.

Despite Costolo’s vow to take a harder line in regards to Twitter trolls and abusers, they’re still being very reactive, rather than proactive; it’s a lot like the bullshit with Zelda Williams being trolled and ran off of Twitter following her dad Robin’s suicide, all over again.

I wonder why there are no calls of denunciation about him from Heritage Foundation, the GOP, CATO Institute, and the rest of the fake, phony “small government” “brain” trusts on the right. Could it be they are all ..well, fake, phony shills for big corporate America? Could it be they are for promoting an overall ideology based on nothing more than immediate financial and political gain,.. and not for anything resembling a truly “free” market and free decisions by private companies?
