Chuck C. Johnson: “I Just Hope Gawker Settles With Me”

Cyberstalker Chuck C. Johnson is blabbing out of control to the Daily Caller’s horrible Betsy Rothstein about Gawker’s latest motions responding to his SLAPP lawsuit. Here’s his egomaniacal rant; obviously his lawyer didn’t tell him to keep his mouth shut about the case (like any competent lawyer would).

“The Gawker response was much weaker than I expected,” he told The Mirror. “It doesn’t rebut any of the substantive claims we make rebutting their libelous claims. They seem to be actually arguing that no one should take their bullshit blogging seriously. The problem is that thousands of people do.

“Rather hilariously their attorneys have decided to smear me again by claiming that my Senator Menendez story is discredited. The same day they filed that the Department of Justice confirmed everything I reported with Matt Boyle and David Martosko years ago. [Actually, if you read what the DOJ actually said, they didn’t confirm what Chuck reported. – ed.]

“Gawker’s lawyers haven’t done their homework but they sure know how to Google. In another example they recycle stories that claim that I outed a rape victim at UVA when we all now know what I knew then that there was no rape at UVA.

“In still another bullshit claim they are saying that because I have contemplated legal action against a number of media organizations for making things up against me, I’m not to be trusted. They don’t take seriously what is obvious: I probably could successful sue a number of these organizations for making things up about me. I just hope that Gawker settles with me before Hulk Hogan — or one of the several other gawker victims — takes all of their money.”

There it is, folks — he gave away his game. From the start, Chuck’s been hoping Nick Denton would just throw some money at him to make him go away. But judging from those motions Gawker’s attorneys filed, that’s not in the cards.

And this is why if you’re going to spread your fecal matter all over the Internet, you better know the lay of the land and who might actually return the favor.

Chucky thought he might get a payday out of a lawsuit that should never have been filed in the first place. He found a lawyer who ought to be ashamed of themselves for even bringing the suit.

And now that the suit has been brought, it can’t be un-brought.

Gawker has no reason to settle here. Not when they are very likely to win outright, and nail Chucky for the costs of defending the initial suit in the first place per the anti-SLAPP suit provisions, and it’s been possible for federal courts to apply the CA provisions to address the circumstances here.

They keys to the suit are contained in these two citations:

Fuqua Homes Inc. v. Beattie 388 F.3d 853
Aoki v. Benihana, Inc. 839 F.Supp2nd

Basically, these state that 1) defamation claims are controlled by the state in which the corporation is based (i.e. Gawker is in NYC and NOT Missouri) and 2) in cases where the defamation is alleged to have occurred on the internet, then the law in the Plaintiff’s domicile (i.e. CCJ is in California) then also applies.

Here’s what happens next: 1) the case removed from Missouri court to Federal.

2) Jurisdiction will be found to be in California, since that is CCJ’s domicile.

3) The anti-SLAPP statutes will then swing into effect.

At that point, it’s all over but the crying. There will be an absolutely MASSIVE judgment against CCJ. He can try to bankrupt himself out of paying it, but Gawker’s attorneys will likely attach all assets and hound that sleazy little fucker to the ends of the earth.

Indeed. I hate saying it as a guy but I really think there are some women who have no appreciation for what women before them fought for. I guess in a way since I’m a history nut as well as sentimental, I never took it for granted that women have the right to vote since my own grandmother would have had memories of that happening. She just missed being able to vote for FDR the first time too. Made it up for the last three though.

Unmarried women who date who they want to should settle down and have a husband. And Ann Coulter who is over 50 is just celibate and not playing the field. I don’t care what people choose to do in their personal lives. I got no issue at all if any of the women on Fox want to have as many boyfriends as they can or even girlfriends if that’s their attraction but the hypocrisy of that network to put down women who work outside the home while having women you guessed it who are working outside the home to do that is disgraceful.

This already happened. Check the latest filings, Gawker is addressing the Federal District Court now. The removal occurred a month ago. CCJ had no opportunity to appeal because removal to federal court is a defendant’s unilateral right in cases over a set amount of money and involving a total diversity of jurisdictions.

2) Jurisdiction will be found to be in California, since that is CCJ’s domicile.

3) The anti-SLAPP statutes will then swing into effect.

Yep. Chuck doesn’t understand that Gawker incurs basically zero risk at this point. They will secure a judgment against him and they will place liens against everything he owns. Denton has zero reason to settle and every reason to make CCJ suffer.

This already happened. Check the latest filings, Gawker is addressing the Federal District Court now. The removal occurred a month ago. CCJ had no opportunity to appeal because removal to federal court is a defendant’s unilateral right in cases over a set amount of money and a total diversity of jurisdictions.

Yep. Chuck doesn’t understand that Gawkers incurs basically zero risk at this point. They will secure a judgment against him and they will place liens against everything he owns. Denton has zero reason to settle and every reason to make CCJ suffer.

I’m really wondering where he goes from here. He’s gonna be in debt up to his eyeballs, his credit’s gonna be tanked, and he has virtually no viable means of earning a living. Considering his run of luck, if he tried to commit suicide staged to look like an accident, not only would the insurance company refuse to pay the claim, but they’d likely bill his corpse for the cost of the investigation.

It’s OK, most life insurance policies have only a 6-12 month no pay on suicide clause. After that, you can off yourself and your beneficiary still gets the full amount. (I recently bought some life insurance, which is why I know this. No, I’m not planning on killing myself.)

I really want to see that since I really think that’s a chapter of the Civil War seldom told- that of those Southern men who were proud Union men.

Another way to put the clampdown on those who claim the CSA was about states rights is to point out that the CSA put down secession movements within their states. There’s going to be a new movie about the Alabama secessionists (pro union). I think Matthew McConnaughey is going to be in it. Forget the title but we’ve discussed it here. I really want to see that since I really think that’s a chapter of the Civil War seldom told- that of those Southern men who were proud Union men.

Hmmm he could have a Southern parent but Dad being a Pirates fan leads me to believe that at least in his father’s case probably not. That makes me sad thinking about Clemetne though. One of the best humanitarians ever to play the game of baseball. He would have been 81 last week.

Clemente was the anti-Schilling. He did more to break down racial animosity than anyone who ever lived in Pittsburgh. No one could hate Clemente except a NY Yankee.

He was so perfect for that city. Did you read the David Maraniss biography on him that came out about 5 or so years back? Really well written and researched. I have a huge soft spot for the 1960 Pirates precisely because they beat the Yankees. Clemente got a hit in all seven games just like he would eleven years later.

Haven’t read it. Our school put the 1960 final game on the PA system.

My grandfather and his brother were natural racists—they didn’t have to put any thought or effort into it, it just came to them. They loved Clemente.
