Chuck C. Johnson: “I Just Hope Gawker Settles With Me”

LOL
Opinion • Views: 70,562

Cyberstalker Chuck C. Johnson is blabbing out of control to the Daily Caller’s horrible Betsy Rothstein about Gawker’s latest motions responding to his SLAPP lawsuit. Here’s his egomaniacal rant; obviously his lawyer didn’t tell him to keep his mouth shut about the case (like any competent lawyer would).

“The Gawker response was much weaker than I expected,” he told The Mirror. “It doesn’t rebut any of the substantive claims we make rebutting their libelous claims. They seem to be actually arguing that no one should take their bullshit blogging seriously. The problem is that thousands of people do.

“Rather hilariously their attorneys have decided to smear me again by claiming that my Senator Menendez story is discredited. The same day they filed that the Department of Justice confirmed everything I reported with Matt Boyle and David Martosko years ago. [Actually, if you read what the DOJ actually said, they didn’t confirm what Chuck reported. – ed.]

“Gawker’s lawyers haven’t done their homework but they sure know how to Google. In another example they recycle stories that claim that I outed a rape victim at UVA when we all now know what I knew then that there was no rape at UVA.

“In still another bullshit claim they are saying that because I have contemplated legal action against a number of media organizations for making things up against me, I’m not to be trusted. They don’t take seriously what is obvious: I probably could successful sue a number of these organizations for making things up about me. I just hope that Gawker settles with me before Hulk Hogan — or one of the several other gawker victims — takes all of their money.”

There it is, folks — he gave away his game. From the start, Chuck’s been hoping Nick Denton would just throw some money at him to make him go away. But judging from those motions Gawker’s attorneys filed, that’s not in the cards.

I wonder what sort of whining we’re going to hear when Chuckles gets taken to the cleaners by Gawker - I expect his meltdown is gonna be one for the history books.

re: #4 The Vicious Babushka

those are the kind of client consults you dream of having as a lawyer.

on the other hand, the one that happened between Chuckles and his attorney, that went something like this:

Saul Goodman: Don’t say anything to anybody about the case. Not one freaking word, you hear me?
Chuckles: But I’ve got all these podcast interviews! I’m going to bury Gawker
Goodman: NOT ONE FREAKING WORD!
Chuckles: Sue me, asshole

are the exact opposite of what you want.

And this is why if you’re going to spread your fecal matter all over the Internet, you better know the lay of the land and who might actually return the favor.

Chucky thought he might get a payday out of a lawsuit that should never have been filed in the first place. He found a lawyer who ought to be ashamed of themselves for even bringing the suit.

And now that the suit has been brought, it can’t be un-brought.

Gawker has no reason to settle here. Not when they are very likely to win outright, and nail Chucky for the costs of defending the initial suit in the first place per the anti-SLAPP suit provisions, and it’s been possible for federal courts to apply the CA provisions to address the circumstances here.

Yeah, something like “Gawker wanted me to pay $550,000 but I talked ‘em into accepting $200,000” or some crap like that.

They keys to the suit are contained in these two citations:

Fuqua Homes Inc. v. Beattie 388 F.3d 853
Aoki v. Benihana, Inc. 839 F.Supp2nd

Basically, these state that 1) defamation claims are controlled by the state in which the corporation is based (i.e. Gawker is in NYC and NOT Missouri) and 2) in cases where the defamation is alleged to have occurred on the internet, then the law in the Plaintiff’s domicile (i.e. CCJ is in California) then also applies.

Here’s what happens next: 1) the case removed from Missouri court to Federal.

2) Jurisdiction will be found to be in California, since that is CCJ’s domicile.

3) The anti-SLAPP statutes will then swing into effect.

At that point, it’s all over but the crying. There will be an absolutely MASSIVE judgment against CCJ. He can try to bankrupt himself out of paying it, but Gawker’s attorneys will likely attach all assets and hound that sleazy little fucker to the ends of the earth.

Indeed. I hate saying it as a guy but I really think there are some women who have no appreciation for what women before them fought for. I guess in a way since I’m a history nut as well as sentimental, I never took it for granted that women have the right to vote since my own grandmother would have had memories of that happening. This already happened. Check the latest filings, Gawker is addressing the Federal District Court now. The removal occurred a month ago. CCJ had no opportunity to appeal because removal to federal court is a defendant’s unilateral right in cases over a set amount of money and involving a total diversity of jurisdictions.

2) Jurisdiction will be found to be in California, since that is CCJ’s domicile.

Speaking of southern heritage

Kayleigh Tipton told WAFF that Brian McCracken showed up to practice wearing a T-shirt that featured a Ku Klux Klansman in a white hood and a burning cross. The caption on his shirt read, “The original boys in the hood.” He was accompanied by his friend, Brian McDowell, who was wearing a “White Pride” shirt.

I do love as a Virginian by way of Pennsylvania union men never relish an opportunity to give a Northerner hell who supports the CSA. I obviously never knew my great great grandfather but I consider him a greater American patriot than Robert E. Lee. I mean that. Lee chose his state over his country in his nation’s darkest hour. GG Daddy chose his adopted country.

re: #78 goddamnedfrank

This already happened. Check the latest filings, Gawker is addressing the Federal District Court now. The removal occurred a month ago. CCJ had no opportunity to appeal because removal to federal court is a defendant’s unilateral right in cases over a set amount of money and a total diversity of jurisdictions.

Yep. Chuck doesn’t understand that Gawkers incurs basically zero risk at this point. They will secure a judgment against him and they will place liens against everything he owns. Denton has zero reason to settle and every reason to make CCJ suffer.

If Chucky’s lawyer wasn’t a fruitloop…well okay, if he wasn’t a fruitloop, we wouldn’t be talking about a case here. But really, were he has sane, he’d be pushing Chuck to find some way to talk settlement for a paltry sum. Financially-crippling, sure, but far lower than what he’s gonna get hit with when Denton files anti-SLAPP and the court brings down the hammer on him. But no, they’re gonna insist on taking this to the bitter end, which is gonna see him hit with fines and fees that will make his eyes water.

Curt Schilling was born in the deep in the heart of Dixie….Anchorage, Alaska.

Curtis Montague Schilling was born on November 14, 1966, in Anchorage, Alaska. His father, Cliff, served in the U.S. Army for the better part of his career and was stationed in Elmendorf Air Force Base at the time. When Curt was brought home from the hospital, there was a baseball glove in the crib that Cliff had placed there. The family moved to Kentucky, Illinois and Missouri before finally settling in Phoenix, Ariz. Curt’s father was a Pirates fan, and the first baseball game Curt ever attended was Roberto Clemente’s last. Curt also was a fan of power pitchers.

I’m really wondering where he goes from here. He’s gonna be in debt up to his eyeballs, his credit’s gonna be tanked, and he has virtually no viable means of earning a living. Considering his run of luck, if he tried to commit suicide staged to look like an accident, not only would the insurance company refuse to pay the claim, but they’d likely bill his corpse for the cost of the investigation.

It’s OK, most life insurance policies have only a 6-12 month no pay on suicide clause. After that, you can off yourself and your beneficiary still gets the full amount. (I recently bought some life insurance, which is why I know this. No, I’m not planning on killing myself.)

In this case Chuck got what he paid for, pretty sure Burns took the case entirely on contingency, for like 75% or more of whatever money was recovered. Chuck had no other options and Burns had him over a barrel, being literally the only lawyer willing to file the suit at all. My prediction is that Chuck is going to end up trying to sue Burns for negligence / legal malpractice when this all blows up in his face.

There were 15 slave states: Florida, Georgia, North and South Carolina, Alabama, Mississippi, Louisiana, Texas, Arkansas, Missouri, Tennessee, Kentucky, Virginia, Maryland, and Delaware.
The constitutional state governments of 11 of these passed secession ordinances and were indisputably part of the Confederacy. The Confederacy recognized the outlaw factions who passed secession ordinances in Missouri and Kentucky. The constitutional governments of these states never seceded though. The slave states of Delaware and Maryland remained in the Union and this was never seriously in question.

After he was unable to get money out at the first bank, he went further afield. But when he finally withdrew money, he realized he had no idea how to retrace his steps - and he’d lost the piece of paper where he’d written down the name of street he’d parked on.

Another way to put the clampdown on those who claim the CSA was about states rights is to point out that the CSA put down secession movements within their states. There’s going to be a new movie about the Alabama secessionists (pro union). I think Matthew McConnaughey is going to be in it. Forget the title but we’ve discussed it here. I’m beginning to wonder how Trump will debate Hillary should it come down to it. If she pisses him off, will he go about calling her a bimbo?

I can see the steam rising out of that patch of hair up top of his head as she questions some of his statements regarding women. He will either have to shut up and let it happen, or he will go into caveman mode.

I wonder if The Donald thinks he could get elected without a majority of women in America voting for him?

I would pay to see that happen.

The anti-China rhetoric coming out of the GOPers it too rich. They were the party that did every last thing it could to ensure the smooth and lucrative transfers of US jobs overseas. China’s MFN status was made permanent in December of 2001 - not December of 2009.

It would appear Schilling is fluffing up his resumé so as to fit into the Trump campaign in some capacity. Liaison to all the racist groups, perhaps. He has some free time now, as I understand it.

Jock welfare. It’s how now convicted rapist Darren Sharper got a job at NFL Network. You played a sport, did pretty well, and can speak English, you’re going to get offered that kind of gig.

And lets not forget Schilling going crazy about the Tweet war he had with some nitwits giving him crap about his minor daughter. I guess he does not learn much about tweeting and how they can be read and spread in very little time. Now he gets to experience the tweet kickback himself.

I’m thinking Curt isn’t very bright. Or, he is too arrogant to actually think about the backlash.

Incompetent lawyers, like CCJ’s, is one thing.

Successfully malicious lawyers are something else:

Attorney Hounding Climate Scientists Covertly Funded By Coal Industry

Christopher Horner, an attorney who claims that the earth is cooling, is known within the scientific community for hounding climate change researchers with relentless investigations and public ridicule, often deriding scientists as “communists” and frauds.

Horner is a regular guest on Fox News and CNN, and has been affiliated with a number of think tanks and legal organizations over the last decade. He has called for investigations of climate scientists affiliated with the Intergovernmental Panel on Climate Change and NASA, and inundated climate researchers at major universities across the country with record requests that critics say are designed to distract them from their work.

New court documents reveal one source of Horner’s funding: big coal.

Last Thursday’s bankruptcy filing of Alpha Natural Resources, one of the largest coal companies in America, includes line items for all of the corporation’s contractors and grant recipients. Among them are Horner individually at his home address as well as the Free Market Environmental Law Clinic, where he is senior staff attorney.

For Japanese gun porn anime see Upotte!
Hulu Video It is a mix of guns and girls for the 13 year old boy. Does provide an education on semi and full automatic weapons and how to behave in totally incorrect manners with weapons. Totally insane anime. No actual porn by the way. Just stupid 13 year old humor.

I really want to see that since I really think that’s a chapter of the Civil War seldom told- that of those Southern men who were proud Union men.

It will be State of Jones or a similar title.

Hmmm he could have a Southern parent but Dad being a Pirates fan leads me to believe that at least in his father’s case probably not. That makes me sad thinking about Clemetne though. One of the best humanitarians ever to play the game of baseball. He would have been 81 last week.

Clemente was the anti-Schilling. He did more to break down racial animosity than anyone who ever lived in Pittsburgh. No one could hate Clemente except a NY Yankee.

He was so perfect for that city. Did you read the David Maraniss biography on him that came out about 5 or so years back? Really well written and researched. I have a huge soft spot for the 1960 Pirates precisely because they beat the Yankees. Clemente got a hit in all seven games just like he would eleven years later.

Haven’t read it. Our school put the 1960 final game on the PA system.

My grandfather and his brother were natural racists—they didn’t have to put any thought or effort into it, it just came to them. They loved Clemente.
