Holocaust Denier Chuck C. Johnson Loses Lawsuit Against Twitter on Anti-SLAPP Motion

Holocaust denying Rage Furby Chuck C. Johnson (who is NOT ME) is having a really bad day.

Johnson foolishly thought he could sue Twitter for banning him. He was wrong.

Today in Fresno his lawsuit crashed and burned spectacularly, as the Court ruled in favor of Twitter’s anti-SLAPP motion. This means that unless it’s reversed on appeal (which is unlikely), Johnson will have to pay Twitter’s attorney costs — and that’s going to be a lot of very real money.

Anyone could have seen this coming, because Johnson’s suit was a classic example of a Strategic Lawsuit Against Public Participation (SLAPP), exactly the kind of case anti-SLAPP statutes are designed to prevent.

Couldn’t happen to a nicer guy.

Johnson’s lawyer Robert Barnes is claiming on Twitter that they were victorious despite the fact that they, um, lost.

Techdirt’s Mike Masnick explains why this is a ridiculous claim.

The key points that Barnes declares “victory” over both appear to involve a somewhat twisted interpretation of what the court is saying. On the first point, of the court declaring Twitter to be a “public forum,” that is true, but specifically in the context of California’s anti-SLAPP law. I mean, the ruling says that explicitly:

In the instant case, the parties appear to agree that (1) Twitter is a public forum for purposes of the anti-SLAPP statute…

The fact that it is a public forum for the purposes of California’s anti-SLAPP statute has no bearing at all on whether or not Twitter is a “public forum” in the sense of spaces created by the government in which speech regulations are limited under the First Amendment. They both use the words “public forum” but they mean totally different things.

The second point, about Twitter’s control over its platform being a “matter of public interest,” is also specific to California’s anti-SLAPP law, which requires the speech in question to be about a matter of public interest. That doesn’t help Johnson’s case at all, unless you’re twisting this specific point concerning anti-SLAPP laws into believing it refers to the government having an interest in regulating how Twitter runs its website. But that would be a totally nonsense interpretation. Though it appears to be the one that Johnson’s lawyer wants to go with. The fact that Twitter agreed to both of the points that Barnes is now celebrating (as is necessary under California’s anti-SLAPP law) should show you why neither of these points is even remotely damaging to Twitter. And, no, this is not Barnes using 9th dimensional chess to get Twitter to admit to something that harms it elsewhere. This is just nonsense.

Say for the sake of argument he came after my county with the same threat. One sheriff, one deputy, two cars (the county just bought another one).

I presume there are a few undocumented migrants in my county, out of the three thousand or so people here.

If the sheriff and the deputy were out and about beating the bushes for people to turn over to ICE on the threat of the county losing federal funding (we do get a little bit), they wouldn’t have any time for the important stuff they do here (like rounding up loose cattle).

My county sheriff (though a Republican) has better stuff to do than harass people for papers. (He still says he’s keeping his eye on me though when he sees me.)

Assuming Chuck’s attorneys can’t change the judge’s mind (narrator: they won’t)…

I’d guess the going rate in Fresno county (where the case was filed) is probably somewhere around $500/hour (that’s about what judges will go for in cases like this in LA/OC/Riverside). I’d also assume they’re probably looking at a justifiable billing of 20-25 hours on this (reviewing the complaint, researching the issues, meeting and conferring with opposing counsel, drafting the motion, reviewing the opposition, drafting the reply brief, preparing for and attending the hearing; and then the fee motion), so they’re probably looking at somewhere around $10-15k.

For what it’s worth: I’ve actually brought and defended these types motions, having won and lost on them. It sucks losing one as the plaintiff (thankfully it wasn’t my firm that wrote that particular cross-complaint, but still… no fun).

Turnout for the primary yesterday was just under 22%, that’s below our recent primaries by a few points (non-presidential primaries have been in the 25-33% range).

That said, it looks like the seats where people were worried Democrats would get locked out of “winnable” races shook out with a Democrat and a Republican moving on, instead of two Republicans.

I’m not quite sure how the calculate the absentee ballots. Some counties start counting those as they come in (which is why on election night we get early returns with 0% reporting), so they might be counted. The 22% is what the Secretary of State is showing, as of this morning. Might tick up a bit, but I doubt there’s enough to get us up to 30% turnout

Looking at the historical data on the CA map page:
vote.sos.ca.gov

I doubt that the final turnout county will be less than the 2010 Primary.

Current SD count is 24.1%, but the uncounted ballots are almost one half of those counted. So if the uncounted ballots are not yet part of the “turnout”, that means the latter indicates that final figure will be a bit higher than the 2010 figure.

I’m glad to see that the Army has settled up with Bowe Bergdahl. Now, I have a very low opinion of deserters, somewhere above looters, ear collectors, and head choppers and way ahead of torturers and rapists, but still a low form of life. Kentucky woman said she found human bones. Sheriff says she was hiding stolen artifacts.

A Carroll County woman was arrested Tuesday after the county sheriff’s office said she made a false report about bones she said she discovered under an abandoned trailer.

Tammy Sculley, 40, told authorities last month that a dog dug up the human bones and brought them to her, Carroll County Sheriff Phillip Marshall said in a press conference Wednesday morning. Following an investigation, it was determined that those bones were archaeological antiquities that two separate people stole from an unspecified building, Marshall said.

A movie called American Animals is about to be released. It’s about the plot by college-aged kids to steal an original Audubon book held in Lexington’s Transylvania University library (I’ve seen the book as I worked there for awhile). The book is huge and apparently worth a lot. When I lived in Lexington I went to an expert on Audubon who talked about the huge toll his work took on the subjects he painted. He had to have dozens, if not hundreds, of each bird so that they could be each be taxidermied into the pose he was aiming for. I guess it was worth it for the nature love he inspired.
