NY Court tosses a GOP suit claiming that NY’s mail in ballots were illegal/improper.
NY has now made it easier to engage in mail in voting - you no longer need an excuse to get a mail in ballot. This opens up voting to underserved communities, which includes those communities where we often saw long lines on election day.
There are still suits regarding redistricting in NY, and NY is a battleground state since the state’s congressional delegation can almost explain how the GOP retook the chamber - from redistricting that tilted to the GOP thanks to Cuomo, the legislature, and the IRC making a mess of the process.

There’s a hilarious take on this interview over on Daily KOS. Apparently, Putin rambled for 40 minutes, not letting Tucker in for air. Instead, he gave 17th century history lessons, how Hitler was justified in invading Poland, and ragging on Tucker for failing to get in the CIA. Quite the clown show.

Piers Morgan is moving his daily show “Uncensored” from television to YouTube, marking the latest transition of traditional broadcasting talent into the digital space.
Morgan has been hosting “Uncensored” on British channel TalkTV since April 2022. He explained in his penultimate televised broadcast on Thursday that the constraints of linear television no longer suited the needs of the show.
“The truth is that many millions of you are watching us on YouTube every day and across our other digital platforms,” Morgan said in the broadcast. “So much so that cutting short our big interviews and debates to squeeze them into a single hour with commercials no longer makes any real sense.”

Whether you’re looking for a timeless jewel, fashion photograph or memorabilia that is quintessentially Elton, these lots offer a treasure for everyone. IBM Reopens Its Frozen Pension Plan, Saving the Company Millions
The company has stopped making contributions to 401(k) accounts, and instead giving workers cash credits in a new version of its old pension plan.
. . . Last month, IBM thawed out a defined benefit pension plan that it had froze more than 15 years ago. The company has also stopped making contributions into employee 401(k) accounts.
These moves are startling, because, on the surface, at least, IBM seems to be reversing a decades-long trend of corporations moving away from traditional pension plans. With the old plans, companies promised to pay employees retirement income that rewarded them for long years of service. But these plans were expensive, and IBM and hundreds of other firms instead began to emphasize 401(k)s that moved the primary responsibility for saving and investing to workers. . .
The move has real advantages for some people who work at IBM, particularly those who put little or no money of their own into 401(k)s and who stay at the company for a relatively short while.
Crucially, IBM’s maneuver is likely to be wonderful for its shareholders. The company is saving hundreds of millions of dollars a year by stopping contributions to employee 401(k) accounts. And it doesn’t need to put any money into the pension plan this year — and, probably, for the next few years — because it has plenty of money already in it. On a purely financial standpoint, IBM is improving its cash flow and bottom line. . .

Not good.
Venezuela is sending troops to its border with Guyana in an escalation of tensions over Guyana’s recent oil boom, according to reports citing satellite images and videos posted by Venezuela’s military.
Venezuela is attempting to annex an area known as Essequibo, in which Venezuela’s President Nicolas Maduro in December said he would “grant operating licenses for the exploration and exploitation of oil, gas, and mines.”
The Essequibo region encompasses about two-thirds of Guyana’s territory and is where most of its oil resources lie, and the site of massive discoveries and new production by Exxon and partners.

No, Russian sympathizers and dupes in America like Patrick Buchanan and Tucker Carlson are claiming that Russia is a theocratic white supremacist fascist state (in overt and less overt ways).
In fact, Russia is completely opposite.
- One of the world’s highest abortion rates.
- A fertility rate that is horrifically low, leading to population collapse sooner rather than later.
- A church that is controlled by the government (rather than a government that is controlled by the church).
- The right wing fear mongers about “Shariah law in the US”, and talk about Dearbornistan, when the Russians have let Muslims _actually_ take over and have full autonomy and institute Shariah law in parts of Russia like Chechnya.
The only real similarities are:
- They hate gays.
- They like strongmen dictators.

I tend to agree with this. One thing that unites all of these rightwing movements is an obsession with the past, true or imagined, and no vision of the future. There is no future in Putin’s mind for Russia: just revenge and return to the “past” with empty victories that prove nothing.
Back when I was working alongside Internal Affairs, we used the shorthand “Wound Collector” to refer to cops who had gone off the deep end into paranoid resentment, and used ANY interaction, no matter how benign, to justify their sense of victimhood, and ugly responses.

When I was in Venezuela, back in 1970-71, there was a whole bunch of Venezuelan domestic drum beating about how the Colombians were going to attack Venezuela and that the Venezuelan Army needed to attack first.
My family knew the American Embassy Military Attache at the time. His assessment was that such a war would be over in 72 hours. With the Colombian Army in Caracas(capital city of Venezuela).
Needless to say, the Venezuelan drum beating was in response to domestic Venezuelan unrest. And nothing came of it.

trying to wrap my taxes up after American Century coughed up their combo 1099 DIV/B/etc. form. I had the very weird experience of discovering a kind of “hole” in the process where my contributing 750 dollars to my HSA resulted in my having taxes owed of about 300 dollars, and where any amount over that did nothing more. Meanwhile, any amount under that resulted in my taxes owed going up to roughly 700 dollars. I’m assuming the deduction is structured as some kind of credit, maybe based on percentage of income? And that any amount over the threshhold does nothing, while an amount less than the threshhold doesn’t trigger anything. I’d kind of assumed it was just a sort dollar for dollar credit, like an IRA contribution. Nope!

Well, “a while ago” as that was, it’s likely the Venezuelan drum-beating was predicated on the realistic assessment that Colombia actually had, y’know, a real army and all: the difference in the situations now is that Guyana probably does not (no idea of that country’s military capabilities - they are likely to be meager). So it’s probably a pleasing prospect for Maduro to “do a Putin” - with the Essequibo region as his “Ukraine” - gloriously “reclaiming” their “lost territory” in a quick cakewalk war against a feeble opponent; and using wartime exigencies to (no surprise) crack down on any domestic opposition.
Of course, the main thing about using wars to boost one’s political popularity is that you have to win…. (usually)

The Book Version of Biden Is Quite Different
“Foer’s book [ The Last Politician] , the most far-reaching study of the Biden White House so far, presents an aging president who’s nonetheless fully engaged in the job, stumbling more when he loses his temper — blurting out Arizona Sen. I’ve been thinking more about the disqualification case, and IMO it’s a complete no-brainer to rule in favor of disqualification, with the only argument necessary being state’s rights/federalism 101. You don’t even need to reach any questions about Trump’s insurrection, lack of criminal conviction thereof etc.
1) The state legislatures pick the electors (or decide how the electors will be picked). That means any state legislature can, as it pleases, cancel president elections within the state and directly pick electors itself. That’s indisputably constitutional, since that’s what the states did for a significant fraction of US history.
2) It is at least arguable that a state could even have presidential elections, and then the state legislature intervene and pick the electors directly if the legislature doesn’t like the result. As far as I know, a naked power grab like this wasn’t done by Republicans in 2020. Instead they did lies and bullshit about the election results.
3) Give this background (especially point #1), there doesn’t even seem to be an argument that CO doesn’t have the power to disqualify presidential candidates from its ballots, for any reason whatsoever (e.g., Trump’s hideous hair). In fact, the disqualification CO is not frivolous, and results from an honest attempt to account for reality (i.e., Trump’s insurrection and the 14th amendment).
Now of course this can all turn into a dumpster fire (especially if GOP-run purple states follow option #2), but federalism is always an invitation to a dumpster fire. It is not SCOTUS’s job to prevent the dumpster fire aspects of federalism/states rights while keeping all parts of that wretched system that favor Republicans.

What are the odds that this is Mike Johnson’s ace in the hole to get Gaetz and the Freedumb caucus to toe the line - that he’d go nuclear to stay in power at any cost, including allowing the investigation to proceed and let the DOJ it’s ok to prosecute Gaetz for child sex trafficking and other assorted crimes.
Yeah, grab your popcorn. This is gonna get salty.

2) It is at least arguable that a state could even have presidential elections, and then the state legislature intervene and pick the electors directly if the legislature doesn’t like the result. As far as I know, a naked power grab like this wasn’t done by Republicans in 2020. Instead they did lies and bullshit about the election results.….
.
That’s true but they would have had to pass a law to redefine how electors were selected. So — the day they knew Trump lost, they would quickly have had to call a special legislative session to change the law? And get it passed and signed before December 14? I supposed they could have tried this months earlier, but there might have been some public objection to such an outrageous change in the rules

The quake was up in Malibu - 4.7 according to an app I have. Just felt like a big sudden jolt here.
Denver weather:
9:30 am — two inches of snow on the ground, full overcast and still snowing, streets wet and a little slick in spots
1:30 pm — bright blue skies with a couple of fluffy clouds, streets and sidewalks dry except for the north-facing areas (like my driveway)
3:00 pm — still sunshine but clouds massing on the western horizon, obscuring all but the first range of hilly things in that direction
6pm — snow predicted to start again, though with luck it might wait till the last bit of rush hour, and continuing all through Saturday. Predictions range from ‘snow showers’ to ‘2-4” in some areas, up to 8” near the foothills’
Sunday — Sunny, high near or at 40
In other words, normal February

I don’t think they could make that retroactive. As in, once the election happened, the results were the results.

The weather here in Northern Virginia is supposed to be 65degF. But with overcast skies and cold ground, it certainly feels colder. Nothing earthshaking, though.

You are right. That would make it an ex post facto law — and those are illegal. So they would have had to do it months earlier, and gotten a lot of probably very bad press for taking that action. OTOH, that’s never stopped modern day Republicans before.
How do you surreptitiously remove and replace a 1,100 lb Wright R-1820 Cyclone 9 engine from one crashed B-17 into another another B-17 while detained by Russian troops? (very carefully)
. . . Returning from his 33rd mission, the mammoth Feb. 3, 1945, air raid on Berlin, Mr. Spiegel managed to belly-land on a frozen potato field in Reczyn, Poland. While the crews’ families were informed that their kin were missing in action, they were held by Russian troops.
Uncertain what to do with putative allies, the Russians awaited orders from their superiors. But instead of staying put, Mr. Spiegel and his fellow officers surreptitiously removed an engine and a tire from their own plane to repair another hobbled B-17 that had crashed nearby. They bartered for fuel and, on March 17, the combined crews escaped to Foggia, Italy, where they were able to notify their families back home that they had survived. Mr. Spiegel led two more missions, then returned home to New York on Aug. 31, 1945. . .
It’s past time for someone to slap the Texas fascists down on basis of the 11th and 14th amendments.
So now, Texas conservatives are testing the limits of their power beyond state lines.
Some cities and counties have passed so-called travel bans aimed at stopping Texans from driving to abortion appointments in other states. Meanwhile, Attorney General Ken Paxton has demanded medical records from at least two out-of-state clinics that provide gender-affirming care to minors.
“This request from the Texas Attorney General is a clear attempt to intimidate providers of gender-affirming care and parents and families seeking that care outside of Texas and other states with bans,” Dr. Izzy Lowell, a Georgia physician who received one such demand letter, said in a statement.
These recent efforts to restrict or scrutinize what Texans do out-of-state raise an important question: Just how far does Texas’ authority over its residents extend?
Is Mr. Majors too dark-skinned to go work for Ben Shapiro, or does abusing women make up for that?
They described Majors as “a controlling, threatening figure who isolated them from friends and career pursuits,” according to a new report in the New York Times. Duncan, Majors’ ex-fiancée, accused the actor of choking her, throwing her around and bruising her. Hooper, who became pregnant and had agreed to an abortion while seeing Majors, also said that he had emotionally abused her. Both Duncan and Hooper told the New York Times that “they experienced his hot and cold tendencies” and “manipulative behavior they have come to understand as love bombing.”
The women’s allegations against the 34-year-old actor were submitted to a New York court ahead of his December trial to show a pattern of behavior, but the judge in Majors’ case did not allow the statements into evidence, the New York Times reported. (The newspaper obtained the statements before the trial and said it subsequently confirmed the interactions by contacting multiple friends of the women and with other documents and records.)
Additionally, the “Ant-Man and the Wasp: Quantumania” and “Creed III” actor was accused of a “history of volatility” while allegedly repeatedly confronting female co-workers on the set of the HBO drama “Lovecraft Country,” leading to a complaint to the network.

Radical Xtians want civil war.
Far-right pastor: ‘Civil war’ would be ‘worth it’ to ‘turn this nation back’ if Trump wins
A far-right evangelical pastor recently suggested that if former President Donald Trump were to be elected to a second term, a “civil war” wouldn’t be entirely unwelcome.
During a recent episode of his Truth & Liberty podcast posted by Right Wing Watch, televangelist Andrew Wommack was addressing a point made by a caller who asked how America could have another revolution to convert the United States to a nation that would “use the Bible as the constitution.” Wommack then talked excitedly conversations he’s had with fellow believers who would “physically fight” for Christian nationalist values.
“I’ve actually had people say that if Trump was to be elected if we got a conservative Congress, that they fear that we would have another civil war,” Wommack said. “And you know what? I don’t want a civil war, I don’t know anybody that does, but would it be worth it? To turn this nation back? I believe it would.”
