Judicial ethics expert who sided with Samuel Alito ‘reversing himself’ with ‘new evidence’

A judicial ethics expert who previously was willing to give Supreme Court Justice Samuel Alito a pass on the extremist symbol on his property, is now convinced he did in fact act unethically, according to The Washington Post.

The analysis came as part of a report that Senate Democrats are putting new pressure on Chief Justice John Roberts to call for Alito’s recusal from the two upcoming Trump cases, involving whether he has presidential immunity from prosecution and whether people involved in January 6 can be charged with obstruction of Congress.

“Stephen Gillers, an expert in judicial ethics at New York University, said he initially gave Alito the benefit of the doubt that the upside-down flag was not tied to the ‘Stop the Steal’ effort. The second flag, he said, makes that theory no longer plausible,” reported Ann E. Marimow and Justin Jouvenal. “[Chief Justice John] Roberts must encourage Alito to recuse himself from the Trump cases and give him a deadline to do so, Gillers said Friday. He said the chief justice should separately address the circumstances surrounding the flying of the flags, even if Alito does not recuse, because of the intense public interest in the upcoming court decisions, which are expected to be announced by the end of June.”

“Gillers noted the consequences of the rulings in those cases for the November presidential election, in which Trump is the presumptive Republican nominee,” noted the report. “He also cited ‘Alito’s failure’s to allay public suspicion with a full explanation for each flag, and the need to reverse the public’s eroding confidence in the court,’” adding, “This is a rare instance when collegiality must yield to protecting the court.”

It is a tradition among elite lawyers to give rightwing elite lawyers the benefit of the doubt, even when their explanation is ludicrous. It’s all part of trying to maintain the belief that the Right still respects the rule of law and has not veered completely off the rails.

I heartily endorse dragging Roberts into the Senate to explain himself. My guess is we’ll end up with some stuck up letter that specifically states that the Supreme Court has no code of ethics, which is a useful thing to wave around when an election’s coming up.

Plus he just voided the warranty… the reason I liked the Rivian is you can give it 15” of clearance for off road mode. That’s a purpose built track for off road practice and it couldn’t do it.

I’ll repeat an observation I’ve noticed here in the Florida Panhandle. The lack of Trump bumper stickers is palpable compared to the last election. It isn’t even close. The conclusions could be a couple of things. 1) voters have already made up their minds and are not going through the effort of tagging their vehicles and yards. 2) voter dedication towards Trump has faltered and could result in flagging support for Trump at the actual polls. 3) Trump supporters are saving their efforts to the end of the election cycle.

There have been no large Bikers for Trump parades, no Boaters for Trump or any other assorted associations of entitled assholes. And DeSantis stickers have also gone away on large part. Take this info as you will.

I hold out hope for November but there are very concerning trends going on that have me searching for other places despite our 4 years left on our business lease.

I’m back from “Mexican Train” dominoes at the public library.

Holy moley there’s a lot of people at the library (about fifty). Two adult prorgrammes are going on, along with a children’s program. Cars and trucks are parked around the library from three counties.

Now that I think of it, I don’t remember any tobacco ads on TV growing up in the USA as a kid — only in print advertisements. And I remember one of my teachers being happy that the teacher’s lounge finally banned cigarette smoking. The last time I saw an actual video tobacco ad was an _old_ add for Marlboro at a movie theater about 25 years ago in a middle eastern country.
