This isn't the first time I've categorically disagreed with Richard Stallman.

I said it wasn't a DDoS but multiple DOSes when it first happened. a DDOS does require a botnet.

I'm not sure if I'd put it in the same category as in the streets political demonstrations though. For one thing that would make it political speech and therefore grant it some some form of constitutional protection. I'm a pretty hardcore civil libertarian but that's getting a bit too wacky for me.

A stream of random data aimed at an open port isn't speech. That's like arguing that drowning out a public speaker by surrounding him with flatbed trucks full of speakers and amps blaring white noise is speech. That's not speech. It has no message other than to try and silence someone else.

He is a bit of a crazy and annoying person. But I can think of few people who have so much authority just by virtue of where he has been within the history of the digital age.

Good point. Stallman's argument misses one of the central conditions of freedom, famously formulated by Rosa Luxemburg: Freedom is always the freedom of dissenters. But taking this further would have to get into questions of net neutrality and such, so I will leave it at that.
