So exactly how much privacy are the police entitled to?

None. They have too much power to be allowed privacy. We have to keep an eye on them at all times.

policeone.com is a private venture and free to set whatever rules it sees fit. However, this follows a pattern of police obstructionism targeting the ability of the public to know why officers have incredible power and almost zero oversight. For example, two officers in Philidelphia this week were charged over the beating of an unarmed man after video surfaced showing them assaulting the prone and unresisting victim on a sidewalk:

Philadelphia District Attorney Seth Williams is now promising to prosecute the officers to “fullest extent” possible. That would make a plea bargain more difficult for the defense counsel given the publicity and anger about the incident.

The importance of the videotape in this controversy cannot be overstated. It also shows why some prosecutors and police continue to seek criminal penalties for citizens filming them in public.

We have been following the continuing abuse of citizens who are detained or arrested for filming police in public. (For prior columns, click here and here). Despite consistent rulings upholding the right of citizens to film police in public, these abuses continue.

The video contradiction of the police account is all too familiar on this blog. Of course, in Dallas, Dallas Police Chief David Brown revealed a new policy that would require officers involved in a shooting to wait 72 hours before making a statement. The policy came after a scandal where a surveillance video showed one of Brown’s officers shooting a mentally ill suspect for no apparent reason. The video contradicted the officer’s testimony and undermined the charge against the victim. Brown’s solution was not greater disciplining and monitoring of officers but to impose a delay to allow officers to craft their statements.

The tendency towards opacity and the outright hostility towards public oversight or accountability is fundamentaly at odds with democratic governance, and it is a menace to the rights of everyday citizens who run across these abuses. policeone.com is feeding the trend.

I’m surprised they waited this long to close off public access. Not that it attracted much if any media attention.

The moment it did this last fall when policeone started making the rounds on twitter, policeone commenters on the various comment threads regarding Ferguson were pitching a fit about getting their views out of public sight. I recall posting at least one of those demands here at LGF back when it happened.

The commetariat is a self selecting group and not a scientific poll of police attitudes, but the comments at policeone were shockingly callous (and used a lot of racial dog whistles) and revealed a deep seated contempt for the public they supposedly serve.

In my opinion, as police officers, very little. As individuals, quite a bit.

The line between the two is something for legislatures, judges, and perhaps juries to decide.
