I would expect that the bill will state that it is not covered by the Supreme Court jurisdiction. The Congress is perfectly able to pass a law and include legislation saying that the Supreme Court has no jurisdiction and cannot review.

But what if a Congress full of Republicans were to pass a Federal enactment of Jim Crow, and include a provision that prevents Federal Courts from having jurisdiction?

As always, it is simply impossible to have a system of checks and balances that can survive absolute bad faith from a major political party.
