They are using SYG or they are not. Cant have it both ways.

Semantics, yes, but those can often count in front of a jury. And while the defense lawyer hopes to avoid a trial, he is preparing in case things reach that point. Remember that defense lawyers are not obligated to be intellectually honest in such matters; The laws allows them to DERP and mislead.
