Maybe a better way to think of this is that we cannot ignore history when discussing law, and that a founding document like our Constitution has to be understood in its original context before we can understand what to do with it today?

If we try to push the clock farther back on our legal system, we even have to get into philology, as it is not necessarily clear to a person in the 21st century what a word meant centuries ago.
