According to Justice Kennedy, unless there is a photo of you and the other party where your faces are uncovered, a bag with an “$” and “Bribe” emblazoned on it, and a paper saying what the bribe is buying all in full view, then it doesn’t constitute bribery. It’s a “campaign donation.”
That theory makes sense only when it is applied to small donations, since a few hundred bucks (for example) is, on its face, just not enough to buy anyone.
But with no donation limits, the ultra wealthy can easily come up with ‘donations’ that are self-evidently enough to buy politicians. For example, the Koch brothers’ latest attempt to give the entire Federal GOP its marching orders.
