Part of the problem is that we haven’t expanded the Supreme Court and lower courts enough to keep up with the growth of the nation. The Court was set at 9 seats when there were 37 states (1869), the follow year the census would count 38.9m Americans. The current estimated population (as of 2018) is 328.95m people.

If the Court were expanded, the value of each seat (and thus the stakes of each vacancy) would be lower. I don’t know what the right answer as to the size, but I think 9 is definitely too small in the modern world.

I really think 13 for each district is fine. I’d probably be more adverse if Mitch hadn’t pulled the stunt he did four years ago but fuck it, not my fault that Republicans can’t accept the modern world.
