Well the argument goes for all Stand Your Ground defenses, so women shouldn’t be “more” likely to go to jail than a man, except inasmuch as there’s still some vestigial bias against women endemic to the system. If there’s no ability to prove intent to rape then there’s equally no ability to prove intent to cause bodily harm against a male shooter, except in both cases for the presence of any weapons on the person shot, their own prior history, etc.

The Marissa Alexander case was a travesty, but more than anything it demonstrates exactly how bad an idea it is to fire off a “warning shot.”

If it anything, it demonstrates that we as a society take more issue with discharging a firearm with the intent to avoid a fatality than it does actually killing a person. If she’d killed hubby, she probably would have had an easier time defending herself in court.
