Charles, I share your confusion. What this guy said was horrible, but can you really have a true democracy without freedom of speech?

The 1st Amendment, which provides free speech protections, still includes some restrictions around unlimited free speech. ‘Fighting Words’ or the use of speech which threatens the public safety (yelling Fire in a crowded theater when no such threat exists) are excluded from free speech protections.

Ultimately, it is a common sense thing - which is probably why the fascists feel the need to have to legislate around common sense.

Clearly, this pinhead needs to lose his job. Any of those at the gym and offended by his outburst should feel free to sue him for assault. But beyond that, the only other thing this nimrod needs to have to worry about is if someone will kick his ass for his use of ‘fighting words’. Jail time isn’t warranted. It will solve nothing. We need to see these bigots in the light of day so they can be confronted and discredited.
