This isn’t tax avoidance (which is legal maneuvering/planning to reduce tax burden), but tax evasion, which is criminal.

The transaction described here appears to be a sham transaction. They characterized it one way, which would be subject to tax, only to recharacterize it as a loan, which would not be taxable.
