It’s a strange argument that the Trump Administration is making - that the mandate is now unconstitutional because the tax penalty has been set at zero. Could the next Congress and administration simply raises the tax penalty to some greater than zero? Does that make the mandate once again constitutional? Or what if, hypothetically, the next Congress and administration was to create a tax credit (in effect a negative penalty) for people buying insurance? If so, it seems rather foolish to say that the mandate is unconstitutional simply because a political decision to set a tax penalty/rate at a low level.
