No, it’s not. Firing the gun can happen in a lot of circumstances without intent to kill, including use during an altercation. That he started it doesn’t mean he intended to shoot until the last moment. If the man is a coward and thought the kid was packing something, he would need to answer for starting the altercation, putting the kid into this position, etc. but it doesn’t show the intent.

After reflection, I have to agree with you. Neither the call nor the decision to pursue prove an intent to kill beyond a reasonable doubt. They do show unlawful intent, and that may very well prove enough to convict Zimmerman of manslaughter. But murder will be harder to prove.
