Not sure about the mineral rights. Would have to check with the cousins who inherited the property. It is located on a fault and the water used is from the cold side of the fault. As I understood it he did have the water rights.

I sympathize with the guy, but according to the feds geothermal resources are unambiguously treated under mineral rights. If BLM owned all the adjacent land or if the feds sold him the deed without transferring those rights then it’s likely he would have lost in the end anyway.

I have seen State issued water rights that grant through passage for hydro-power systems, and for use of the warm water surface output from naturally occurring hotsprings. Magic Hot Springs in Idaho was for sale and used to have all the documents available on a website.
