Not if Kushner was ordered to do this by Trump himself. We’ll have to see how this pans out, but it’s pretty doubtful that Kushner decided to tell Flynn to contact Russians all on his own.

Kushner doesn’t do anything on his own. He’s being told what to do by Trump (or Ivanka or Junior). He wasn’t freelancing any of this.

He’s not that smart.

Also, it’s quite likely that Trump was independently informing Flynn to act. Remember, there are multiple threads here that Mueller’s pulling on and the entire mess of an admin is unraveling before our eyes in slow motion.

After all, Trump was calling Flynn a great guy even months after he fired him. Trump is also known to have maintained contact with the likes of Lewandowski and Manafort after they were “fired/resigned” from the campaign. He keeps his cronies close.
