I think she should sue, but I don’t think she’s going to be able to win. You have to prove malice and she is a public figure. High bars there.

She may have a tough time winning. Breitbart probably will have a bigger war chest.

However, a good case can be made that although she worked for some mundane government agency, she was not a ‘pubic figure’ and likely prone to regular flack. A case could be made for that, advantage Sherrod.
