He is arguing that the privacy statute as written in Missouri means that even though he took the photos of the naked tied up woman in question, he did not violate the law.

(The statute says that photographs can be taken of others where there is not expectation of privacy, and being tied up naked in the governor’s basement is his argument she had no expectation of privacy, and therefore he did not need consent.)
