I’ve said it before.

Even if the ‘unborn’ are constitutional persons (they aren’t) that would not give them automatic, unquestionable, superior rights over anyone else. There is no special protection or class.

Whether that be the mother or me.
No difference.

We argue conflicting rights cases all the time.

Yes I know some people are more equal than others. And I still think the fundamental argument is about bodily autonomy for everybody. Still I think this might be one avenue of the fight.

Definitely would not work. That would mean that in any anti-choice red state where a woman wanted/needed to terminate a pregnancy, she would have to go to court to argue the case. It is not only the financial costs that would burden both the court system and the individual woman, it is also the danger to the woman’s life when hours could make the difference between survival and death/permanent physical harm.
