Trump should be indicted on the strength of this audio tape showing that he knew these documents were still classified and still in his possession post-WH. He mishandled and stole those documents. He knew he wasn’t supposed to be in possession of them. He knew that they had value.

And he held on to them, lied to DOJ, FBI, and the National Archives. He lied. His lawyers lied. His lawyers misrepresented assertions about returning all these documents. His lawyers misrepresented or conspired with Trump. Or his lawyers were lied to by Trump (and the crime fraud exception is helpful at determining whether these lawyers should be prosecuted as accomplices, or they were just dumb enough to be working for Trump and took Trump assertions at face value).
