Arizona Birther Bill is 'Set Aside'

I was fired up against this bill when it first came out. I was listening to the hype, silly me. The left spin machine wants everyone to believe it’s the coming of nazism. From what I can see, all it does is say that if someone commits a crime, they can be questioned about their citizenship. Just as if there was reason to believe they had drugs. Oh, the horror. I can almost hear the stormtroopers marching.


I’m worried about this

FOR ANY LAWFUL CONTACT MADE BY A LAW ENFORCEMENT OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE WHERE REASONABLE SUSPICION EXISTS THAT THE PERSON IS AN ALIEN WHO IS UNLAWFULLY PRESENT IN THE UNITED STATES, A REASONABLE ATTEMPT SHALL BE MADE, WHEN PRACTICABLE, TO DETERMINE THE IMMIGRATION STATUS OF THE PERSON. THE PERSON’S IMMIGRATION STATUS SHALL BE VERIFIED WITH THE FEDERAL GOVERNMENT PURSUANT TO 8 UNITED STATES CODE SECTION 1373(c).


And this……

E. A LAW ENFORCEMENT OFFICER, WITHOUT A WARRANT, MAY ARREST A PERSON IF THE OFFICER HAS PROBABLE CAUSE TO BELIEVE THAT THE PERSON HAS COMMITTED ANY PUBLIC OFFENSE THAT MAKES THE PERSON REMOVABLE FROM THE UNITED STATES.

Wouldn’t being an illegal immigrant be a public offense for which someone can be removed from the US?

Thus a lay enforcement officer can arrest any person they want who they think is an illegal immigrant on sight?

But I leave it to a law lizard more well versed in law to tell me if I’ve got the right of it or if I’m mistaken.
